【摘要】：近年來,我國經(jīng)濟(jì)迅猛發(fā)展,綜合國力不斷增強(qiáng),偷渡犯罪有了新的發(fā)展趨勢(shì),我國開始慢慢退出偷渡出境國的歷史,逐漸向過境國、中轉(zhuǎn)國和目的國轉(zhuǎn)化。據(jù)筆者多年在實(shí)務(wù)工作中積累的資料來看,我國偷渡犯罪在犯罪趨勢(shì)、犯罪方法、犯罪人員主體都有了新的特點(diǎn),產(chǎn)生了新的問題,需要我們對(duì)我國偷渡犯罪的現(xiàn)狀做一個(gè)系統(tǒng)的梳理。筆者立足于犯罪學(xué)的實(shí)證分析,發(fā)現(xiàn)這些問題的出現(xiàn)是經(jīng)濟(jì)、法制、社會(huì)制度等因素綜合作用的結(jié)果。針對(duì)其治理也必須在我們對(duì)國內(nèi)形勢(shì)有充分的把握的前提下,重拳出擊,對(duì)癥下藥,從法制建設(shè)層面、制度設(shè)計(jì)層面以及國際合作等方面綜合入手,以解決當(dāng)前面臨的實(shí)際問題。
[Abstract]:In recent years, with the rapid development of China's economy, the comprehensive national strength has been increasing, the crime of smuggling has a new development trend, China began to slowly withdraw from the history of smuggling out of the country, gradually to transit countries. According to the data accumulated by the author in practice for many years, the crime of smuggling in our country has new characteristics and new problems in crime trend, crime method and criminal subject. The author based on the empirical analysis of criminology, found that the emergence of these problems is the economy, the legal system. As a result of the comprehensive action of social system and other factors. In view of its governance, we must also have a full grasp of the domestic situation under the premise of a heavy fist attack, the right medicine, from the legal construction level. The system design and international cooperation are integrated to solve the current practical problems.
