【摘要】：現(xiàn)代科技的發(fā)展帶動了司法鑒定在刑事訴訟中的運用和擴(kuò)大,鑒定結(jié)論的危險性與重要性的并存促使人們探尋對鑒定結(jié)論證據(jù)能力的規(guī)范。英美法系對專家證據(jù)的可采性強(qiáng)調(diào)對其依據(jù)方法的考察,大陸法系強(qiáng)調(diào)訴訟程序?qū)﹁b定結(jié)論的制度。在對兩大法系鑒定結(jié)論證據(jù)能力進(jìn)行詳盡分析的基礎(chǔ)上,筆者從鑒定人的適格性、鑒定的關(guān)聯(lián)性、鑒定結(jié)論的可靠性、鑒定材料的合法性和鑒定的程序性要件上完善我國鑒定結(jié)論的證據(jù)能力。
[Abstract]:The development of modern science and technology has led to the application and expansion of forensic expertise in criminal proceedings. The coexistence of the danger and the importance of the expert conclusion urges people to explore the criterion of the evidential ability of the expert conclusion, and the common law system emphasizes the investigation of the basis method of the expert evidence. On the basis of the detailed analysis of the evidential capacity of the two legal systems, the author analyzes the suitability of the appraiser and the relevance of the appraisal. The reliability of the appraisal conclusion, the legality of the appraisal material and the procedural elements of the appraisal are the evidential ability to perfect the conclusion of our country.
