【摘要】：以文化的視角研究法與國(guó)家問(wèn)題是近年來(lái)法治理論發(fā)展的重要建構(gòu)目標(biāo)。俄羅斯作為多元文化并存、種族分化日益嚴(yán)重的風(fēng)險(xiǎn)社會(huì),在法治國(guó)家構(gòu)建過(guò)程中面臨著法制的統(tǒng)一性與文化多元性的價(jià)值沖突。如何平衡二者之間的矛盾,通過(guò)對(duì)傳統(tǒng)的法律文化之于當(dāng)下俄羅斯法治國(guó)家構(gòu)建有益營(yíng)養(yǎng)的汲取,并適時(shí)地對(duì)傳統(tǒng)法律文化進(jìn)行現(xiàn)代化的引導(dǎo)和改造,從而實(shí)現(xiàn)有利于社會(huì)穩(wěn)定、民族團(tuán)結(jié)的現(xiàn)代法治的社會(huì)國(guó)家建構(gòu)目標(biāo),成為當(dāng)今俄羅斯國(guó)家文化發(fā)展的重要時(shí)代使命。
[Abstract]:The study of law and state from the perspective of culture is an important construction goal of the development of the theory of rule of law in recent years. Russia, as a risk society where multiculturalism coexists and ethnic differentiation is becoming more and more serious, is faced with the value conflict between the unity of legal system and cultural diversity in the process of building a country ruled by law. How to balance the contradiction between the two, by absorbing the beneficial nutrition of the traditional legal culture to the present Russian country ruled by law, and timely guiding and reforming the traditional legal culture, so as to realize the social and state construction goal of modern rule of law conducive to social stability and national unity, has become an important mission of the times for the development of Russian national culture.
