【摘要】：唐宋時(shí)期法典編纂從律令格式到敕令格式的轉(zhuǎn)變,學(xué)界的探討,多就法典體系內(nèi)部的法律形式,及其變遷問題,忽略了法典編纂產(chǎn)生的背景。因此,將法典編纂同王朝政治體制與政務(wù)運(yùn)行機(jī)制聯(lián)系起來,嘗試把握法典體系與政治體制、政務(wù)運(yùn)行機(jī)制的關(guān)系,有助于探究唐宋變革背景下的宋代法典編纂變遷問題。
[Abstract]:The transformation of the compilation of the code from the form of the law to the format of the royal decree in the Tang and Song dynasties, the academic discussion, mostly on the internal legal form of the code system, and its changes, neglects the background of the compilation of the code. Therefore, linking the codification of the code with the political system of the dynasty and the operation mechanism of the government affairs, and trying to grasp the relationship between the code system and the political system and the operation mechanism of the government affairs, is helpful to explore the changes of the compilation of the code in the Song Dynasty under the background of the reform of the Tang and Song dynasties.
