【摘要】：清代是我國(guó)統(tǒng)一多民族國(guó)家進(jìn)一步發(fā)展的重要?dú)v史時(shí)期,尤為注重運(yùn)用法律手段管理和治理邊疆少數(shù)民族地區(qū)。清王朝對(duì)于貴州民族地區(qū)的法律治理,在遵循"因俗而治"統(tǒng)治策略的基礎(chǔ)上,針對(duì)不同地區(qū)、不同生產(chǎn)、生活領(lǐng)域適用了相宜的法律治理手段。對(duì)于涉及封建統(tǒng)治基本秩序的刑事法律領(lǐng)域積極地引入國(guó)家法;而對(duì)于被官府視為"細(xì)務(wù)鎖故"的民事法律領(lǐng)域則為當(dāng)?shù)厣贁?shù)民族習(xí)慣法保留了一定的適用空間;在糾紛解決機(jī)制中,依據(jù)糾紛的不同類型,作出靈活的規(guī)定等。
[Abstract]:Qing Dynasty is an important historical period for the further development of the unified multi-ethnic country in China, especially paying attention to the use of legal means to manage and govern the border minority areas. On the basis of following the ruling strategy of "ruling because of vulgarity", the Qing Dynasty applied appropriate legal governance means to different areas, different production and life fields. The national law is actively introduced into the criminal law field involving the basic order of feudal rule, while the civil law field, which is regarded by the government as "detailed locking", retains a certain applicable space for the local minority customary law. In the dispute resolution mechanism, flexible provisions are made according to the different types of disputes, and so on.
