【摘要】：正當(dāng)下,完善社會(huì)主義法律體系、全面推進(jìn)依法治國(guó)成為我國(guó)法治建設(shè)的重要面向。在這一過(guò)程中,推進(jìn)依法行政、公正司法、全民守法,成為全社會(huì)的基本共識(shí)。重新認(rèn)識(shí)和觀察法律為何,成為確立守法意識(shí)、樹(shù)立法治信念的新起點(diǎn)。以此為背景,法律實(shí)證主義理應(yīng)重新引起我們的重視。進(jìn)言之,我們應(yīng)當(dāng)就自身的生活事實(shí)和經(jīng)歷出發(fā),思考"為什么要遵守法律"。英國(guó)著名法理學(xué)家哈特則在《法律的概念》一書(shū)中,既批判了以?shī)W斯丁為代表的傳統(tǒng)法律實(shí)證主義傳統(tǒng),又批判了自然法學(xué)派、實(shí)用主義法學(xué)
[Abstract]:Under the right circumstances, perfecting the socialist legal system and promoting the rule of law in an all-round way have become an important orientation of the construction of the rule of law in our country. In this process, promoting administration according to law, fair administration of justice and abiding by the law by the whole people has become the basic consensus of the whole society. Re-understanding and observing the law has become a new starting point to establish the consciousness of abiding by the law and the belief of the rule of law. Against this background, legal positivism should arouse our attention again. In other words, we should think about "why abide by the law" on the basis of our own life facts and experiences. In his book the concept of Law, Hart, a famous British jurist, criticizes not only the traditional legal positivism tradition represented by Austin, but also the natural law school and pragmatism law.
