【摘要】：確定性是語言在特定條件或語境下相對具體化的展現(xiàn)。法律規(guī)范的適用,是規(guī)范語詞的模糊性和確定性相互調(diào)適和轉(zhuǎn)化的過程。由此,闡釋成為架通二者的必經(jīng)橋梁。闡釋中,應(yīng)注重以法律規(guī)則或法律原則背后最小意義單元的價(jià)值為原點(diǎn),通過意向性活動(dòng)對蘊(yùn)含著豐富內(nèi)涵的價(jià)值進(jìn)行多維度的勾連和整合,進(jìn)而,在闡釋者與被闡釋者的視域融合中形成同構(gòu)共相體。同時(shí),在眾多復(fù)雜因素的交互作用下,圍繞相互趨同的價(jià)值軸心,通過多數(shù)議決或綜合折洽機(jī)制,形成有機(jī)共識,從而獲取具備社會整合功能的建構(gòu)性結(jié)論。
[Abstract]:Certainty is a relatively concrete representation of language under specific conditions or contexts. The application of legal norms is the process of adjusting and transforming the fuzziness and certainty of words. As a result, interpretation has become a necessary bridge between the two. In the interpretation, we should take the value of the minimum meaning unit behind the legal rules or legal principles as the origin, connect and integrate the value which contains rich connotation through intentionality activities, and then, In the fusion of the field of view between the interpreter and the interpreter, an isomorphism common phase is formed. At the same time, under the interaction of many complex factors, around the value axis of convergence, through most decisions or comprehensive compromise mechanism, an organic consensus is formed, so as to obtain the constructive conclusion with the function of social integration.
