【摘要】：市場經(jīng)濟(jì)催生信用經(jīng)濟(jì),由于我國目前正處于社會(huì)經(jīng)濟(jì)結(jié)構(gòu)轉(zhuǎn)型期和市場經(jīng)濟(jì)制度完善期,信用權(quán)、信用義務(wù)、信用責(zé)任,均缺乏法律規(guī)范和制度規(guī)范的調(diào)整。法學(xué)界對(duì)信用權(quán)討論較多,卻忽視了信用義務(wù)和責(zé)任的重要性。文章在著重探討信用權(quán)的同時(shí),也對(duì)信用義務(wù)和責(zé)任進(jìn)行了初步的探討。對(duì)于三者的關(guān)系,本文也結(jié)合法理進(jìn)行了討論,認(rèn)為三者應(yīng)當(dāng)結(jié)合起來共同促進(jìn)信用法制建設(shè)。
[Abstract]:Market economy gives birth to credit economy, because our country is in the transition period of social and economic structure and the perfection of market economy system at present, credit right, credit obligation and credit responsibility are lack of adjustment of legal norms and system norms. There are many discussions on credit rights in the field of law, but the importance of credit obligations and responsibilities is ignored. This paper not only focuses on the credit right, but also makes a preliminary discussion on the credit obligation and responsibility. This paper also discusses the relationship between the three, and holds that the three should be combined to promote the construction of credit legal system.
