【摘要】：美國(guó)在縱向非價(jià)格限制規(guī)制上,從1963年的White Motor公司案適用合理規(guī)則,到1967年Schwinn案的本身違法規(guī)則,再?gòu)谋旧磉`法規(guī)則重回1977年Sylvania案的合理規(guī)則,美國(guó)在縱向非價(jià)格限制領(lǐng)域規(guī)制問(wèn)題上積累了十分豐富的執(zhí)法和司法經(jīng)驗(yàn)。通過(guò)了解美國(guó)在該領(lǐng)域的經(jīng)驗(yàn),結(jié)合我國(guó)市場(chǎng)經(jīng)濟(jì)發(fā)展?fàn)顩r和法律運(yùn)行的中國(guó)語(yǔ)境,不斷完善我國(guó)的《反壟斷法》縱向非價(jià)格限制條款,明確本身違法規(guī)則和合理規(guī)則的適用,注重縱向地域限制和顧客限制規(guī)制的經(jīng)濟(jì)分析,制定中國(guó)版本的反壟斷指南,為促進(jìn)市場(chǎng)經(jīng)濟(jì)的健康發(fā)展和完善我國(guó)反壟斷法律體系提供借鑒。
[Abstract]:In the vertical non-price restriction regulation in the United States, from the application of reasonable rules in the White Motor Company case in 1963 to the illegal rules in the Schwinn case in 1967, and then from the illegal rules in the Sylvania case in 1977 to the reasonable rules in the Sylvania case in 1977, the United States returned to the reasonable rules in the 1977 Sylvania case. The United States has accumulated a wealth of law enforcement and judicial experience in the field of vertical non-price restrictions. By understanding the experience of the United States in this field, combining with the development of China's market economy and the Chinese context of legal operation, we have constantly improved the vertical non-price restriction clause of the Anti-monopoly Law of our country, and made clear the application of our own illegal rules and reasonable rules. Pay attention to the economic analysis of vertical regional restriction and customer restriction regulation, formulate the Chinese version of antitrust guide, and provide reference for promoting the healthy development of market economy and perfecting the antitrust legal system of our country.
