【摘要】：隨著社會(huì)經(jīng)濟(jì)的發(fā)展,人口流動(dòng)加劇,打破了傳統(tǒng)鄉(xiāng)土社會(huì)結(jié)構(gòu),而受到農(nóng)耕文化等因素的傳承和熏陶,人們長(zhǎng)期形成的習(xí)俗難免與現(xiàn)行的法規(guī)政策存在沖突。本文以全面建設(shè)小康社會(huì)視野下民俗與社會(huì)治理存在的沖突為切入點(diǎn),通過對(duì)全面建設(shè)小康社會(huì)中殯葬、婚約彩禮、民間信仰以及祭祀祭祖等民俗與法律、政策沖突的梳理,分析民俗與法律存在沖突的具體形態(tài)和糾紛類型。提出在推進(jìn)城鎮(zhèn)化過程中,既要維護(hù)政策、法律的權(quán)威,也應(yīng)充分考慮民俗在居民中的重要影響,充分尊重民風(fēng)民俗;主管部門應(yīng)在公序良俗原則和合法合理原則的基礎(chǔ)上設(shè)計(jì)和推行具體措施,建設(shè)經(jīng)濟(jì)、政治、文化、社會(huì)、生態(tài)文明全面發(fā)展的小康社會(huì)。
[Abstract]:With the development of social economy and the aggravation of population flow, it has broken the traditional local social structure, and has been inherited and nurtured by the factors such as farming culture. It is inevitable that the customs formed for a long time are in conflict with the current laws and regulations. Based on the conflict between folk custom and social governance under the view of building a well-off society in an all-round way, this paper combs the conflicts between folk customs and laws, such as funeral and burial, wedding betrothal gifts, folk beliefs and sacrificial sacrifices to ancestors in a well-off society in an all-round way. This paper analyzes the specific forms and types of disputes between folk customs and laws. In the process of promoting urbanization, we should not only safeguard the policy, the authority of the law, but also fully consider the important influence of folk custom in the residents, and fully respect the folk custom; The competent department should design and carry out concrete measures on the basis of the principles of public order, good custom and lawful and reasonable, so as to build a well-off society with all-round development of economy, politics, culture, society and ecological civilization.
