【摘要】：作為我國法律體系當(dāng)中的一個重要法律概念,"政策"極少在法規(guī)范意義上得到解讀。從法律形式角度看,自1979年至2016年3月10日,共計有88部法律(含憲法)247條條文直接使用了政策概念,使用頻次達(dá)306次;從制定主體來看,法律將"國家""政府"和特定領(lǐng)導(dǎo)機構(gòu)視為政策的主要制定主體;從表現(xiàn)形式來看,法律所認(rèn)可的政策種類形式多樣。隨著法治的發(fā)展,政策的法律地位發(fā)生了巨大變化,但是政策概念在法律中的使用頻次并未逐步減少。民事法律當(dāng)中政策概念使用多,刑事法律當(dāng)中基本不使用政策概念;實體法當(dāng)中政策概念使用多,而程序法當(dāng)中政策概念非常罕見。而且,政策具有獨立于法律之外的規(guī)范性。從功能來看,政策在我國法治發(fā)展過程當(dāng)中具有規(guī)范行為、價值定位和導(dǎo)引發(fā)展的作用。從類型來看,法律當(dāng)中的政策主要有法律之上的政策、法律之中的政策和法律之下的政策。在推進(jìn)法治中國建設(shè)的背景下,政策法治化是當(dāng)代中國的一個重大課題。
[Abstract]:As an important legal concept in China's legal system, Policy is rarely interpreted in the sense of legal norms. From the legal form point of view, from 1979 to 10 March 2016, a total of 88 laws (including the Constitution) 247 articles directly used the policy concept, used 306 times; From the point of view of the main body of formulation, the law regards the "state", "the government" and the specific leading bodies as the main subjects of the policy-making, and from the form of expression, the types of policies recognized by the law are diverse. With the development of rule of law, the legal status of policy has changed greatly, but the use frequency of policy concept in law has not gradually decreased. There are many policy concepts in civil law, but no policy concepts in criminal law, while policy concepts in substantive law are used in a lot, while policy concepts in procedural law are very rare. Moreover, policy has norms independent of the law. From the function point of view, policy has the function of normative behavior, value orientation and guiding development in the process of our country's rule of law development. From the point of view of type, the policy in the law mainly includes the policy above the law, the policy in the law and the policy under the law. Under the background of promoting the construction of China ruled by law, the legalization of policy is an important issue in contemporary China.
