【摘要】：普通法法律中心觀念是"關(guān)系","關(guān)系"來源于中世紀(jì)的"土地保有制",這種制度成為普通法"關(guān)系"的主要表現(xiàn)形式,其不僅在私法中體現(xiàn)了不同主體的利益關(guān)系,也促進(jìn)了公法理論的進(jìn)步,這為后來的社會(huì)契約思想打下了基礎(chǔ)。在社會(huì)化日益增強(qiáng)、極端個(gè)人主義弊端凸顯的近代法律中,普通法的"關(guān)系"又重新復(fù)歸,其中以龐德為代表的法學(xué)家在此基礎(chǔ)上對(duì)其進(jìn)行了進(jìn)一步闡釋,使"關(guān)系契約"體現(xiàn)在法律觀念中,普通法"關(guān)系"具有時(shí)空性,其本質(zhì)體現(xiàn)了整體觀念、系統(tǒng)觀念,能夠抑制個(gè)人主義,實(shí)現(xiàn)個(gè)人利益之間分配的平衡,體現(xiàn)了法律主體的社會(huì)人假設(shè)和社會(huì)權(quán)利救濟(jì)功能。
[Abstract]:The concept of legal center in common law is "relationship", which originates from "land tenure" in the Middle Ages. This system has become the main manifestation of "relationship" in common law, which not only embodies the interest relationship of different subjects in private law, but also reflects the relationship of interests of different subjects in private law. It also promoted the progress of public law theory, which laid the foundation for the later thought of social contract. In the modern law, which is becoming more and more socialized and the disadvantages of extreme individualism are prominent, the "relationship" of the common law has been reinstated. On this basis, the jurist, represented by pound, has further explained it. So that the relationship contract is embodied in the legal concept, the common law "relationship" has time and space, its essence embodies the whole idea, the system idea, can restrain individualism, realizes the individual benefit distribution balance, It embodies the social person hypothesis and the social right relief function of the legal subject.
