立法后評(píng)估法律制度研究

【摘要】:近年來(lái),我國(guó)的立法主體積極探索提高立法質(zhì)量的各種方式和途徑,立法后評(píng)估制度就是其中的成果之一。廣義的立法過(guò)程論認(rèn)為立法后評(píng)估是立法過(guò)程中的重要一環(huán)。目前,我國(guó)法學(xué)界對(duì)立法后評(píng)估制度的研究尚處于起步階段,實(shí)踐探索和理論研究的空白使得法學(xué)界,尤其是立法學(xué)界,對(duì)此制度的價(jià)值未達(dá)成一致看法。 本文在綜合考察國(guó)內(nèi)外尤其是我國(guó)地方各級(jí)人民政府開(kāi)展立法后評(píng)估實(shí)踐情況的基礎(chǔ)上,重點(diǎn)研究立法后評(píng)估制度在我國(guó)的科學(xué)構(gòu)建。緒論介紹目前各地開(kāi)展立法后評(píng)估工作的一些情況,并對(duì)研究立法后評(píng)估制度的重要性作了闡述,明確了全文將要探討的問(wèn)題的主旨和思路以及研究方法。除前言外,正文共分為四部分,具體結(jié)構(gòu)如下:第一章闡述了立法后評(píng)估制度的概念。開(kāi)篇總結(jié)了目前學(xué)界對(duì)立法后評(píng)估概念的不同理解,對(duì)立法后評(píng)估制度進(jìn)行了界定。同時(shí)通過(guò)與執(zhí)法檢查、法律績(jī)效評(píng)估等相似概念的比較闡述了立法后評(píng)估制度的特征。在本章末揭示了建立立法后評(píng)估制度的理論依據(jù)。第二章通過(guò)考察立法后評(píng)估制度在我國(guó)的演進(jìn)。介紹我國(guó)開(kāi)展立法后評(píng)估的實(shí)踐情況,綜述我國(guó)立法后評(píng)估尚處于起步階段的現(xiàn)狀,歸納我國(guó)目前立法后評(píng)估制度的不足之處,強(qiáng)調(diào)目前我國(guó)的立法后評(píng)估活動(dòng)亟需制度化的規(guī)范和指引,為后續(xù)論述立法后評(píng)估制度的構(gòu)建提供實(shí)證基礎(chǔ)。第三章全面、創(chuàng)新地構(gòu)建了我國(guó)科學(xué)、合理的立法后評(píng)估制度,包括評(píng)估主體、評(píng)估對(duì)象、評(píng)估標(biāo)準(zhǔn)、評(píng)估程序,推動(dòng)我國(guó)立法后評(píng)估制度的法制化。本章首先借鑒國(guó)外做法,推動(dòng)立法后評(píng)估制度的法制化,接著從建立統(tǒng)一的評(píng)估標(biāo)準(zhǔn)、多元的評(píng)估主體、合理確定評(píng)估對(duì)象以及完善評(píng)估程序等四個(gè)方面對(duì)我國(guó)的立法后評(píng)估制度進(jìn)行構(gòu)建和完善。第四章在憲政視野下論述了我國(guó)建立立法后評(píng)估制度的可行性和必要性。
[Abstract]:In recent years, the main body of legislation in our country has actively explored various ways and means to improve the quality of legislation, among which the post-legislative evaluation system is one of the achievements. The broad legislative process theory thinks that the post-legislative evaluation is an important part of the legislative process. At present, the research on the post-legislative evaluation system is still in its infancy in the field of law in our country, and the gap of practical exploration and theoretical research makes the legal circles, especially the legislative circle, not agree on the value of this system. Based on the comprehensive investigation of the practice of post-legislative evaluation at home and abroad, especially by the local people's governments at all levels, this paper focuses on the scientific construction of the post-legislative evaluation system in China. The introduction introduces some situations of the post-legislative evaluation in various places at present, expounds the importance of studying the post-legislative evaluation system, and clarifies the purport, train of thought and research methods of the issues to be discussed in the full text. In addition to the preface, the text is divided into four parts, the specific structure is as follows: the first chapter describes the concept of post-legislative evaluation system. In the beginning, the author summarizes the different understanding of the concept of post-legislative assessment and defines the system of post-legislative evaluation. At the same time, the characteristics of the post-legislative evaluation system are discussed by comparing with the similar concepts such as law enforcement inspection, legal performance evaluation and so on. At the end of this chapter, it reveals the theoretical basis of establishing the post-legislative evaluation system. The second chapter examines the evolution of the post-legislative evaluation system in China. This paper introduces the practice of post-legislative evaluation in China, summarizes the current situation that the post-legislative evaluation is still in its infancy, and summarizes the shortcomings of the current post-legislative evaluation system in China. It is emphasized that it is urgent to institutionalize the post-legislative evaluation activities in China to provide an empirical basis for the subsequent discussion on the construction of the post-legislative evaluation system. The third chapter comprehensively and innovatively constructs the scientific and reasonable post-legislative evaluation system of our country, including the evaluation subject, the object, the evaluation standard, the evaluation procedure, and promotes the legalization of the post-legislation evaluation system in our country. This chapter first draws lessons from foreign practices to promote the legalization of the post-legislative evaluation system, and then from the establishment of a unified evaluation criteria, multiple evaluation of the main body, This paper constructs and perfects the system of post-legislative evaluation in four aspects: reasonable determination of evaluation object and perfection of evaluation procedure. The fourth chapter discusses the feasibility and necessity of establishing the post-legislative evaluation system in the field of constitutionalism.
