【摘要】：外國投資法律制度是一國法律制度的重要組成部分，其對于吸引投資，促進(jìn)經(jīng)濟(jì)發(fā)展，保障投資者合法權(quán)利有著極為重要的作用。土庫曼斯坦是中亞地區(qū)重要的政治經(jīng)濟(jì)實(shí)體，其政治經(jīng)濟(jì)的發(fā)展對于我國而言存在著十分重要的影響。隨著全球經(jīng)濟(jì)一體化的深入，，我國與土庫曼斯坦之間的經(jīng)濟(jì)交往將更為頻繁，因此對土庫曼斯坦投資法律進(jìn)行深入研究具有十分重要的現(xiàn)實(shí)意義。 筆者以土庫曼斯坦政府在2008年10月16日頒布的《外國投資法》作為本文研究的核心，結(jié)合土庫曼斯坦的其他相關(guān)法律法規(guī)，以國際投資法的基本理論分析為切入點(diǎn)，運(yùn)用理論研究法、比較研究法等分析方法，以發(fā)展的視角著重分析土庫曼斯坦投資法律制度的基本內(nèi)容，并在此基礎(chǔ)上對土庫曼斯坦投資法律制度作出了客觀的評析，期望能夠為我國投資者向土庫曼斯坦投資規(guī)避法律風(fēng)險提供若干防范對策及建議。
[Abstract]:The legal system of foreign investment is an important part of a country's legal system, which plays an extremely important role in attracting investment, promoting economic development and protecting the legal rights of investors. Turkmenistan is an important political and economic entity in Central Asia. With the deepening of global economic integration, the economic exchanges between China and Turkmenistan will be more frequent, so it is of great practical significance to study the investment laws of Turkmenistan. The author takes the Foreign Investment Law promulgated by the Government of Turkmenistan on October 16, 2008 as the core of this study, and combines with other relevant laws and regulations of Turkmenistan, taking the basic theoretical analysis of the international investment law as the breakthrough point. In this paper, the author analyzes the basic contents of Turkmenistan's investment legal system from the perspective of development, and makes an objective assessment of Turkmenistan's investment legal system based on the theoretical research method and comparative research method. It is expected to provide some countermeasures and suggestions for Chinese investors to invest in Turkmenistan to avoid legal risks.
