【摘要】：本文一共分為四個部分。第一部分為文章的緒論部分,介紹了本文的研究緣起、研究現(xiàn)狀、選題意義、研究方法和創(chuàng)新點。通過第一章的介紹回顧了近年來相關學者們對中國法制研究史和中共中央法律委員會的研究現(xiàn)狀,也指出了目前在這一領域研究的意義和存在的不足,同時對本文的研究方法和創(chuàng)新點做出了說明。第二部分以時間為主線,介紹了中共中央法律委員會成立前、成立期間到撤銷后的情況,介紹了從抗日根據(jù)地時期到解放戰(zhàn)爭時期中國共產(chǎn)黨領導法制工作的情況,說明了中國共產(chǎn)黨在當時有什么樣的任務與挑戰(zhàn),同時取得了哪些成就與經(jīng)驗。與此同時,詳細敘述了中共中央法律委員會的機構設置以及中央法律委員會的工作性質(zhì)與工作任務。第三部分,論述了中共中央法律委員會的工作內(nèi)容及取得的成就,分別列出了中共中央法律委員會在參與廢除偽法統(tǒng)、草擬中華人民共和國臨時憲法,負責起草和擬定了《婚姻條例草案》、《刑事訴訟暫行條例》等法律條例,制定司法干部訓練計劃和創(chuàng)辦了政法大學中所做的努力和貢獻。顯示出了中共中央法律委員會中國法制建設史上取得的無可代替歷史成就。第四部分,客觀的對中共中央法律委員歷史貢獻做出了評價,指出其為新中國的成立提供了一定的法律支撐,并且為黨領導法制工作奠定了組織基礎。同時,也對在當時歷史背景下的中央法律委員會所受到的局限性進行了闡述。最后得出結論,我們可以結合對中共中央法律委員會研究所得到的啟示和中共中央法律委員會存在的問題,在加快建設社會主義法治社會和維穩(wěn)思維的主導背景下,為中國法律發(fā)展指明了方向,為社會主義法制建設提供了新的思路。
[Abstract]:This paper is divided into four parts. The first part is the introduction of the article, introduces the origin of this study, research status, the significance of the topic, research methods and innovation. Through the introduction of the first chapter, this paper reviews the research status of the Chinese legal system research history and the law commission of the CPC Central Committee in recent years, and also points out the significance and shortcomings of the current research in this field. At the same time, the research method and innovation of this paper are explained. The second part, taking time as the main line, introduces the situation before, during and after the establishment of the CPC Central Committee's Law Commission, and from the period of the Anti-Japanese Base area to the period of the War of Liberation, the work of the CPC in leading the legal system. It explains what tasks and challenges the Communist Party of China had at that time, and what achievements and experiences it has made at the same time. At the same time, the establishment of the Central Law Commission of the CPC Central Committee and the nature and task of the work of the Central Law Commission are described in detail. The third part discusses the contents and achievements of the Law Commission of the Central Committee of the Communist Party of China (CPC), and lists the participation of the Law Commission of the CPC Central Committee in the abolition of the false legal system and the drafting of the interim Constitution of the people's Republic of China. Responsible for drafting and drafting of the draft Marriage regulations, Provisional regulations on Criminal Proceedings and other laws and regulations, formulating training plans for judicial cadres, and making efforts and contributions made in the establishment of the University of political Science and Law. It shows that the CPC Central Committee Law Commission has made irreplaceable historical achievements in the history of China's legal system construction. The fourth part objectively evaluates the historical contribution of the CPC Central Committee Law Committee and points out that it provided a certain legal support for the founding of New China and laid an organizational foundation for the Party to lead the legal work. At the same time, the limitations of the Central Law Commission under the historical background were expounded. Finally, it is concluded that we can combine the enlightenment to the study of the Law Commission of the CPC Central Committee and the problems existing in the Law Commission of the CPC Central Committee, under the dominant background of speeding up the construction of a socialist society ruled by law and maintaining stability. It points out the direction for the development of Chinese law and provides a new way of thinking for the construction of socialist legal system.
