【摘要】：正西方特別是美國(guó)的犯罪治理實(shí)踐表明,刑事政策的寬嚴(yán)取舍與社會(huì)穩(wěn)定狀況相關(guān),社會(huì)相對(duì)穩(wěn)定容易助推刑罰福利主義,形成輕緩的刑事政策;社會(huì)治安惡化則會(huì)導(dǎo)致刑罰福利主義衰弱,刑事政策日趨嚴(yán)厲。這說明,價(jià)值理念、刑事政策與社會(huì)穩(wěn)定三者之間有著密切的內(nèi)在聯(lián)系。自上世紀(jì)80年代始,西方刑罰福利主義思想對(duì)我國(guó)的刑事政策理論與實(shí)踐的影響日益顯現(xiàn),進(jìn)入新世紀(jì)以來,這種影響更逐漸占據(jù)了主導(dǎo)地位。雖然近年來在日益嚴(yán)峻的犯罪現(xiàn)實(shí)面前,刑罰福利主義思潮有些收斂,但刑罰福利主義價(jià)值理念仍對(duì)我國(guó)當(dāng)前的刑事政策有著廣泛而深遠(yuǎn)的影響,并與我國(guó)傳統(tǒng)的"治亂世需用重典"思想產(chǎn)生了
[Abstract]:The crime management practice in the West, especially in the United States, shows that the lenient and strict choice of criminal policy is related to the social stability, and the relative stability of the society is easy to promote the criminal welfare doctrine and form a mild criminal policy. The deterioration of public order will lead to the weakening of criminal welfare and the increasingly severe criminal policy. This shows that there is a close relationship between value concept, criminal policy and social stability. Since the 1980s, the western criminal policy theory and practice have been influenced by the western criminal welfarism. Since the beginning of the new century, this kind of influence has gradually occupied the leading position. In recent years, in the face of the increasingly serious crime reality, the trend of thought of criminal welfarism has somewhat converged, but the value concept of criminal welfarism still has a wide and far-reaching influence on the current criminal policy of our country. And with our country's traditional thought of "governing the troubled times need heavy code" came into being.
