從歷史視角看12世紀(jì)羅馬法復(fù)興的原因

【摘要】：對于每個國家來說,法制建設(shè)在社會生活中都發(fā)揮著極其重要的作用。近年來,隨著經(jīng)濟的發(fā)展,我國也迫切需要健全的法律體系。作為民法的淵源,羅馬法的研究也越來越多地引起國內(nèi)外學(xué)者的關(guān)注,本文旨在探討羅馬法律在12世紀(jì)復(fù)興的原因。 古羅馬帝國滅亡后,羅馬法的法律制度并沒有隨之消失。但是在某種意義上可以說,羅馬法乃至整個法學(xué)都已經(jīng)處于停滯和衰退的狀態(tài)。在11世紀(jì)以前,西歐各國普遍以日耳曼習(xí)慣法為自己的法律標(biāo)準(zhǔn)。隨著西歐農(nóng)業(yè)的進步、商業(yè)的復(fù)興以及城市和行會的興起,西歐的人們開始自我覺醒,再加上中世紀(jì)教權(quán)與皇權(quán)在很長一段時期內(nèi)都相互博弈,西歐各國普遍需要一套完善的、統(tǒng)一的法律體系來適應(yīng)社會的發(fā)展。伴隨著《民法大全》的重新被發(fā)現(xiàn),羅馬法再一次登上了歷史舞臺。 全文一共分為三個部分：第一部分論述了12世紀(jì)羅馬法的復(fù)興在經(jīng)濟、政治、宗教以及文化領(lǐng)域內(nèi)的表現(xiàn)。第二部分是本文中心所在,從經(jīng)濟發(fā)展、宗教改革以及政治結(jié)構(gòu)和文化現(xiàn)象等四個方面詳細(xì)論述了羅馬法律在12世紀(jì)復(fù)興的原因。第三部分探討了羅馬法律復(fù)興的意義以及由此帶來的影響。
[Abstract]:For every country, the construction of legal system plays an extremely important role in social life. In recent years, with the development of economy, our country also urgently needs a sound legal system. As the origin of civil law, the study of Roman law has attracted more and more attention from scholars at home and abroad. This paper aims to explore the reasons for the revival of Roman law in the 12th century. After the fall of the Roman Empire, the legal system of Roman law did not disappear. But in a sense, Roman law and even the whole jurisprudence have been in a state of stagnation and decline. Before the 11 th century, western European countries generally regarded Germanic customary law as their own legal standard. With the progress of Western Europe's agriculture, the revival of commerce and the rise of cities and guilds, people in Western Europe began to awaken themselves. In addition, in the Middle Ages, religious power and imperial power all played games with each other for a long time, and Western European countries generally needed a set of perfect. A unified legal system to adapt to the development of society. With the rediscovery of Civil Law, Roman law once again ascended the stage of history. This paper is divided into three parts: the first part discusses the economic, political, religious and cultural aspects of the revival of Roman law in the 12th century. The second part is the center of this paper, from four aspects of economic development, religious reform, political structure and cultural phenomena, the reasons for the revival of Roman law in the 12th century are discussed in detail. The third part discusses the significance of Roman legal revival and its impact.
