【摘要】：柏拉圖在《國家篇》中提出并論證了"哲人政體",并在《政治家篇》里延續(xù)了對"真正的政制"的思考。但是,正是《政治家篇》將法治視為劃分政體類型的一個(gè)基本標(biāo)準(zhǔn),形成了關(guān)于法治政體的思想,從而開創(chuàng)了西方法政思想史上的法治政體類型學(xué)。而在《法篇》、《米諾斯》以及第七、八封書信中,柏拉圖一方面進(jìn)一步提升了法治的地位和意義,另一方面闡釋了"混合政體"的主張與設(shè)想。柏拉圖始創(chuàng)的法治政體類型學(xué)和"混合政體"思想,奠定了西方法治政體思想的基礎(chǔ)。
[Abstract]:Plato put forward and demonstrated the "philosopher regime" in "the country", and continued to think about "the real political system" in the "statesman". However, it is the statesman that regards the rule of law as a basic criterion for the classification of the political system and forms the thought of the rule of law, thus creating the typology of the rule of law in the history of western legal thought. On the one hand, Plato promotes the status and significance of the rule of law, on the other hand, he explains the ideas and ideas of "mixed government". Plato's typology of the rule of law and the thought of "mixed regime" laid the foundation of the thought of the rule of law in the West.
