【摘要】：為了應(yīng)對日益嚴峻的反恐形勢,馬來西亞通過了一系列反恐立法:在《刑法》中設(shè)專章規(guī)定了恐怖主義犯罪,通過了《預(yù)防恐怖主義法案》和《對抗外國恐怖主義特殊措施法案》,完善了《反洗錢和反恐怖主義融資法》,從而形成了相對完善的反恐立法體系,但是部分反恐措施也引起了巨大爭議。借鑒馬來西亞的經(jīng)驗教訓(xùn),可從以下方面完善我國反恐立法:在刑法分則設(shè)立恐怖主義犯罪專節(jié),修訂涉恐偷越國(邊)境行為的罪名和法定刑,加強對旅行證件的控制,注意反恐實踐中的人權(quán)保障。
[Abstract]:In response to the increasingly serious anti-terrorism situation, Malaysia has adopted a series of anti-terrorism legislation: a special chapter in the Criminal Code provides for the crime of terrorism. The Prevention of Terrorism Act and the Special measures against Foreign Terrorism Act were passed, and the Anti-Money-Laundering and Anti-Terrorism financing Act was perfected, thus forming a relatively sound counter-terrorism legislative system. But some anti-terrorism measures have also caused great controversy. Learning from Malaysia's experience and lessons, we can improve our counter-terrorism legislation from the following aspects: the establishment of a special section on terrorist crimes in the specific provisions of the Criminal Law, the revision of the charges and legal penalties related to acts of terrorist smuggling across the border, and the strengthening of the control of travel documents. Attention should be paid to the protection of human rights in the practice of counter-terrorism.
