【摘要】：正法治不是一個單向度的概念,控制濫用權力,強調規(guī)則之治,保障基本權利,維持社會秩序與安全等,都是法治所追求的目標。法治體現(xiàn)在立法、執(zhí)法、司法、守法等一系列的過程中。通過法治指標評估法治狀況,必然是多向度的,既可以在體現(xiàn)法治的各個環(huán)節(jié)的層次上進行,也可以在法治體系層次上進行。如何開展科學的法治評估,是當前一項重大的課題。法治評估的前提法治指標是一種特殊的社會指標,通過可以量化的數(shù)據(jù)描述和評價法治狀況,判斷所研究的現(xiàn)象從何
[Abstract]:The rule of law is not a unidirectional concept. The goal of the rule of law is to control the abuse of power, to emphasize the rule of law, to protect the basic rights and to maintain social order and security. The rule of law is embodied in a series of processes, such as legislation, law enforcement, judicature, law-abiding and so on. It is necessary to evaluate the state of the rule of law by the index of rule of law, which can not only be carried out at the level of each link of the rule of law, but also at the level of the system of rule of law. How to carry out scientific evaluation of the rule of law is a major issue at present. The premise of rule of law evaluation is a special social index. Through quantifiable data to describe and evaluate the rule of law, we can judge the phenomenon studied.
