【摘要】：奸罪作為一種古老的罪名,歷代法典都對(duì)其進(jìn)行了規(guī)制,《大清律例》則集歷代法典之大成,對(duì)奸罪的種類、處罰原則等等進(jìn)行了系統(tǒng)、詳細(xì)的規(guī)定,而清代的司法實(shí)踐則在很大程度上踐行了《大清律例》對(duì)奸罪的處罰規(guī)定,《大清律例》對(duì)奸罪的立法規(guī)定總體上得到了很好的適用。清末變法改革,奸罪立法也發(fā)生了轉(zhuǎn)型,本文即對(duì)上述內(nèi)容進(jìn)行逐一論述,并對(duì)清代奸罪立法作出幾點(diǎn)思考。
[Abstract]:The crime of adultery, as an ancient charge, has been regulated by the successive dynasties' codes. The "Qing laws" have collected the great achievements of the successive dynasties' codes. The types of crimes of rape, the principles of punishment, and so on have been systematically and detailedly stipulated. On the other hand, the judicial practice of the Qing Dynasty to a large extent carried out the punishment of the crime of rape, and the legislative provisions of the law of the Qing Dynasty on the crime of adultery were applied well on the whole. The reform of the law in the late Qing Dynasty, the crime of rape legislation has also undergone a transformation, the above content is discussed one by one, and the Qing Dynasty rape legislation made several considerations.
