【摘要】：秋審是明清時期地方官員和中央對死刑監(jiān)候案件進(jìn)行審錄與復(fù)核,死刑勾決上報皇帝以決定最終刑罰的司法制度。秋審的思想淵源可追溯至漢唐以來"秋冬行刑"的傳統(tǒng),其量刑、審判及運(yùn)行原則是中國傳統(tǒng)法律文化精神的體現(xiàn),秋審其制背后反映了傳統(tǒng)社會"因時行刑"和"恤刑"的理念與實(shí)踐。隨著清末法律改革的推進(jìn),各級審判廳的籌備與建立使原有的一省督撫職掌司法與行政的體制發(fā)生改變,秋審人犯的解勘隨之變通。秋審改革的背后反映了近代以來中西法文化的碰撞與交融,民國時仍有回響。
[Abstract]:Autumn trial is a judicial system in which the local officials and the central authorities of the Ming and Qing dynasties tried and reviewed the death penalty cases and reported the death penalty to the emperor to decide the final punishment. The ideological origin of autumn trial can be traced back to the tradition of "execution in autumn and winter" since Han and Tang dynasties. The principles of sentencing, trial and operation are the embodiment of the spirit of Chinese traditional legal culture. The system of autumn trial reflects the concept and practice of "execution because of time" and "compassionate punishment" in traditional society. With the advancement of the law reform in the late Qing Dynasty, the preparation and establishment of the trial hall at all levels changed the judicial and administrative system of the former provincial governor and governor, and the interpretation and modification of the autumn trial criminals followed. The reform of autumn trial reflected the collision and blending of Chinese and western cultures since modern times, and there was still reverberation in the Republic of China.
