【摘要】："特殊主義"與"普遍主義"的矛盾一直伴隨著沖突法的歷史發(fā)展。歷史上最早形成的沖突法理論即巴托魯斯的"法則區(qū)別說(shuō)"是以民族國(guó)家為本位的比較溫和的特殊主義理論范式,在其后的發(fā)展中走向了比較極端的特殊主義。18世紀(jì)末,薩維尼的"法律關(guān)系本座說(shuō)"是隨著資本主義世界市場(chǎng)的開(kāi)拓而產(chǎn)生的以國(guó)際社會(huì)為本位的普遍主義理論范式。20世紀(jì)美國(guó)沖突法學(xué)界出現(xiàn)了特殊主義沖突法理論的復(fù)興。片面的特殊主義和普遍主義各有其局限性,"最密切聯(lián)系原則"的提出,表現(xiàn)出特殊主義和普遍主義融合統(tǒng)一的傾向,代表了當(dāng)代沖突法理論發(fā)展的基本趨勢(shì)。
[Abstract]:The contradiction between "particularity" and "universalism" has been accompanied by the historical development of conflict law. The earliest theory of conflict of laws formed in history, namely Bartolus's "Law differentiation Theory", is a more moderate and special theoretical paradigm based on nation-state, and in the course of its subsequent development, it has moved towards the more extreme specialism, which was at the end of the 18th century. Savini's "legal relation theory" is an international society-oriented universalism theoretical paradigm with the development of capitalist world market. In the 20th century, the conflict law theory of special doctrine was revived in American conflict law circles. One-sided particularism and universalism have their own limitations. The proposition of "the principle of the closest connection" shows the tendency of the integration of particularity and universalism, which represents the basic trend of the development of contemporary conflict law theory.
