【摘要】：立法聽證制度對(duì)于提高立法的民主化進(jìn)程具有重要意義,但是由于我國(guó)的立法聽證制度起步較晚,致使這一制度在現(xiàn)實(shí)狀況下難以發(fā)揮其應(yīng)有的作用。尤其是《中華人民共和國(guó)立法法》和《規(guī)章制定程序條例》對(duì)于立法聽證的規(guī)定不明確,這導(dǎo)致我國(guó)目前立法聽證制度缺乏可操作性�？傮w來講,我國(guó)立法聽證制度還處于探索階段。本文以協(xié)商民主理論與我國(guó)立法聽證制度的契合性為基礎(chǔ),通過協(xié)商民主理論關(guān)于公民參與、能力平等和公共協(xié)商的對(duì)話機(jī)制對(duì)我國(guó)立法聽證制度的啟示,探索完善我國(guó)立法聽證制度的有效機(jī)制。 協(xié)商民主理論與立法聽證制度的契合之處在于,它們都是主張通過協(xié)商來證成決策的合法性。協(xié)商民主理論對(duì)民主的立法程序給予了適當(dāng)?shù)年P(guān)注,通過在立法程序中發(fā)揮民主的協(xié)商功能,可以提高立法的民主化程度。論文第一部分簡(jiǎn)要概述了協(xié)商民主理論。協(xié)商民主理論的來源有二,它們分別是自由憲政主義和批判理論。論文第二部分論述了協(xié)商民主理論關(guān)于公民參與、能力平等觀和公共協(xié)商的對(duì)話機(jī)制對(duì)于完善我國(guó)立法聽證制度的重要啟示。在立法聽證中發(fā)揮公民參與的作用,并不要求所有法律的制定都舉行立法聽證,立法聽證的范圍應(yīng)該界定在一定的限度內(nèi),即事關(guān)公民重大權(quán)益的變動(dòng)或事關(guān)公共利益。能力平等觀的提出要求對(duì)公民立法聽證能力的提高予以關(guān)注,在立法聽證過程中通過充滿包容性的議程設(shè)置和集體行動(dòng)的思考可以有效彌補(bǔ)公民參與能力的不足。公共協(xié)商的對(duì)話機(jī)制對(duì)于立法聽證制度的重要價(jià)值體現(xiàn)在它對(duì)構(gòu)建立法聽證制度中的對(duì)話機(jī)制產(chǎn)生了重要啟示。論文第三部分結(jié)合我國(guó)立法聽證制度的現(xiàn)狀,以協(xié)商民主理論為視角從完善立法聽證參加人的遴選機(jī)制、立法聽證的議程設(shè)置和立法聽證報(bào)告制度三個(gè)方面進(jìn)行了探索。這三個(gè)方面,分別關(guān)注立法聽證的開始、過程和結(jié)果,這三各方面的改革和完善對(duì)于我國(guó)立法聽證制度的構(gòu)建具有重要的意義。 論文的研究意義在于通過對(duì)政治學(xué)上協(xié)商民主理論的研究,探求協(xié)商民主理論與我國(guó)立法聽證制度的契合性,并在此其礎(chǔ)上提出建構(gòu)和完善我國(guó)立法聽證制度的有效路徑。立法聽證的過程實(shí)際上也是立法聽證參加人公開運(yùn)用理性,進(jìn)行公共協(xié)商的過程,因此協(xié)商民主理論中關(guān)于公共協(xié)商的制度架構(gòu)對(duì)于完善我國(guó)立法聽證制度具有重要的借鑒意義。
[Abstract]:The system of legislative hearing is of great significance for improving the process of democratization of legislation. However, due to the late start of the system of legislative hearing in our country, it is difficult for this system to play its due role in reality. In particular, the provisions of the Legislative Law of the people's Republic of China and the rules and regulations on the legislative hearing are not clear, which leads to the lack of maneuverability of the current legislative hearing system in China. Generally speaking, our legislative hearing system is still in the exploratory stage. On the basis of the agreement between the theory of deliberative democracy and the system of legislative hearing in China, this paper, through the dialogue mechanism of the theory of consultative democracy on citizen participation, equality of ability and public consultation, gives enlightenment to the system of legislative hearing in our country. To explore and perfect the effective mechanism of our country's legislative hearing system. The consensus between the theory of deliberative democracy and the system of legislative hearing is that they all advocate the legitimacy of decision-making through consultation. The theory of deliberative democracy pays due attention to the democratic legislative process. By exerting the democratic consultative function in the legislative process, the degree of democratization of the legislation can be improved. The first part of the thesis gives a brief overview of the theory of deliberative democracy. There are two sources of the theory of deliberative democracy: free constitutionalism and critical theory. In the second part, the author discusses the important enlightenment of the theory of consultative democracy on citizen participation, ability equality and public consultation for the improvement of our country's legislative hearing system. In order to play the role of citizen participation in the legislative hearing, it is not required that all laws be made to hold the legislative hearing. The scope of the legislative hearing should be defined within a certain limit, that is, the change of the major rights and interests of the citizen or the public interest. In the process of legislative hearing, we should pay close attention to the improvement of citizens' ability of legislative hearing, and make up for the deficiency of citizens' ability to participate by setting inclusive agenda and thinking about collective action. The important value of the dialogue mechanism of public consultation to the legislative hearing system is that it has important enlightenment to the construction of the dialogue mechanism in the legislative hearing system. The third part of the thesis combines the current situation of the legislative hearing system in our country, from the angle of view of the theory of deliberative democracy, it explores from three aspects: perfecting the selection mechanism of the participants in the legislative hearing, setting the agenda of the legislative hearing and reporting the legislative hearing. These three aspects pay attention to the beginning, process and result of the legislative hearing respectively. The reform and perfection of these three aspects are of great significance to the construction of the legislative hearing system in our country. The research significance of the thesis lies in the research on the theory of deliberative democracy in political science, to explore the conformity between the theory of deliberative democracy and the system of legislative hearing in our country, and on this basis, to put forward the effective way to construct and perfect the system of legislative hearing in our country. In fact, the process of legislative hearing is also a process in which the participants of the legislative hearing openly use reason and conduct public consultation. Therefore, the institutional framework of public consultation in the theory of deliberative democracy has important reference significance for perfecting the system of legislative hearing in our country.
