【摘要】：近年來(lái),美國(guó)錯(cuò)案數(shù)激增的形勢(shì)嚴(yán)峻不容樂(lè)觀,引起了美國(guó)司法界的高度重視。因此,美國(guó)頒布DNA法案、制定"無(wú)辜者計(jì)劃",并且建立了各種與美國(guó)國(guó)情相適應(yīng)的救濟(jì)機(jī)制。中國(guó)司法界需要積極了解美國(guó)錯(cuò)案糾錯(cuò)制度,從中學(xué)習(xí)并借鑒與我國(guó)相適應(yīng)的有益之處,對(duì)錯(cuò)案的糾正、責(zé)任追究、國(guó)家賠償?shù)纫幌盗袉?wèn)題進(jìn)行深刻的反思,并建立起冤假錯(cuò)案有效的防治機(jī)制,科學(xué)全面地采取有效措施防止國(guó)內(nèi)冤假錯(cuò)案的發(fā)生。
[Abstract]:In recent years, the sharp increase in the number of wrong cases in the United States is not optimistic and has aroused great attention in American judicial circles. Therefore, the United States enacted the DNA Act, formulated the innocent Plan, and established various relief mechanisms adapted to the national conditions of the United States. The Chinese judicial circles need to actively understand the error correction system in the United States, learn from it and learn from the beneficial points adapted to our country, and deeply reflect on a series of problems, such as the correction of wrong cases, the investigation of responsibility, the compensation of the state, and so on. And set up the effective prevention and cure mechanism of unjust false and wrong cases, and take effective measures to prevent the occurrence of domestic unjust false and wrong cases in a scientific and comprehensive way.
