【摘要】：地方立法質(zhì)量跟蹤評(píng)估是一種立法后評(píng)估,在地方性法規(guī)、規(guī)章實(shí)施一段時(shí)間后,對(duì)其實(shí)施效果、總體質(zhì)量等方面進(jìn)行綜合分析評(píng)估。地方性法規(guī)、規(guī)章由于其必須面對(duì)的地方性背景和人文地理社會(huì)環(huán)境等因素的影響,其實(shí)施本身就是一個(gè)復(fù)雜的系統(tǒng)工程。由于我國(guó)目前各地方還沒(méi)有形成比較認(rèn)可的統(tǒng)一質(zhì)量評(píng)估標(biāo)準(zhǔn),擬從價(jià)值的合理性、文本質(zhì)量的科學(xué)性、立法實(shí)施的有效性三個(gè)方面對(duì)跟蹤評(píng)估標(biāo)準(zhǔn)進(jìn)行詮釋與構(gòu)建。地方立法質(zhì)量跟蹤評(píng)估作為我國(guó)立法體系的重要組成環(huán)節(jié),能夠有利于改進(jìn)和完善地方立法工作,提高地方立法的科學(xué)性和針對(duì)性。隨著我國(guó)法律體系的基本形成,地方性法規(guī)、規(guī)章在"良法"的應(yīng)然價(jià)值理念指導(dǎo)下,充分運(yùn)用評(píng)估結(jié)果,及時(shí)啟動(dòng)法規(guī)、規(guī)章的立、改、廢程序,為地方立法機(jī)關(guān)提供決策依據(jù)。并將地方立法質(zhì)量跟蹤評(píng)估制度的相關(guān)結(jié)論從應(yīng)然和實(shí)然角度進(jìn)行了具體應(yīng)用。
[Abstract]:The quality tracking evaluation of local legislation is a kind of post-legislation evaluation. After the local laws and regulations are implemented for a period of time, the effect of implementation and the overall quality are comprehensively analyzed and evaluated. The implementation of local laws and regulations is a complicated system engineering because of the influence of local background and humanistic geography and social environment. Due to the fact that there is no unified quality evaluation standard in various parts of our country at present, this paper intends to interpret and construct the evaluation standard from three aspects: the rationality of value, the scientific nature of text quality and the validity of legislative implementation. As an important component of our country's legislative system, the quality tracking and evaluation of local legislation can help to improve and perfect the local legislative work and improve the scientificity and pertinence of local legislation. With the basic formation of our country's legal system, local laws and regulations, under the guidance of the "good Law" should be the value concept, the full use of evaluation results, timely initiation of laws, regulations, reform, repeal procedures, To provide a basis for local legislatures to make decisions. And the relevant conclusions of the local legislation quality tracking and evaluation system are applied from the angle of ought and reality.
