【摘要】：美國是目前郵輪旅游立法比較完善的國家,其通過《郵輪安全與安保法》《國際郵輪旅客權(quán)利法案》等法律規(guī)制郵輪承運人,保障郵輪旅客的合法權(quán)益。2013年以來,美國相繼制定《郵輪旅客保護法》及《郵輪旅客信任法案》等提案,對于郵輪旅客的權(quán)利保護作出了更為詳盡和細致的規(guī)定。中國未來郵輪立法可從旅游、船舶建造技術(shù)、行政監(jiān)管和郵輪旅游合同當事人權(quán)責方面借鑒美國郵輪法律制度。
[Abstract]:The United States is a country with relatively perfect legislation on cruise tourism. It has adopted laws to regulate cruise carriers, such as the Cruise Safety and Security Act and the International Cruise passenger Rights Act, to protect the legitimate rights and interests of cruise passengers. The United States has formulated the "Cruise passenger Protection Act" and the "Cruise passenger confidence Act" one after another, which has made more detailed and detailed provisions on the protection of the rights of cruise passengers. China's future cruise legislation can draw lessons from the American cruise legal system from the aspects of tourism, shipbuilding technology, administrative supervision and the rights and responsibilities of the parties to the cruise contract.
