【摘要】：立法中的地方利益本位本質(zhì)上是公共權(quán)力的價值選擇和利益偏好的合法化,其集中表現(xiàn)為行政部門利益的法制化和保護主義的法制化。作為具有"獨特的利益偏好"的政府部門主導(dǎo)地方立法的結(jié)果,它帶來了立法權(quán)力異化的風(fēng)險,包括增加地方政府間競爭的"交易成本"、違背法治的權(quán)力約束和平等的尊重原則、鞏固地方權(quán)威主義的治理模式并加劇其合法化危機。對此,可行的對策是提升地方人大的民主立法能力、建立立法回避制度、落實違法違憲審查機制。
[Abstract]:The local interest standard in legislation is essentially the legalization of the value choice and interest preference of public power, which is mainly manifested in the legalization of the interests of administrative departments and the legalization of protectionism. As the result of leading local legislation by government departments with "unique interest preference", it brings the risk of alienation of legislative power. It includes increasing the "transaction cost" of the competition between local governments, violating the principle of power restriction and equal respect of the rule of law, consolidating the governance model of local authoritarianism and exacerbating the crisis of legalization. The feasible countermeasures are to improve the democratic legislative ability of the local people's congresses, to establish the legislative avoidance system and to implement the review mechanism of illegal and unconstitutional laws.
