【摘要】：法律的抽象性、滯后性使得立法中不可避免出現(xiàn)各種過失現(xiàn)象,立法過失的存在影響了法律體系的完善和公民權(quán)利的保障。我國(guó)的立法過失現(xiàn)象主要包括立法的顯性與隱性不作為、上下位法律沖突、法律規(guī)范內(nèi)部沖突以及作為實(shí)質(zhì)立法的司法解釋違法等。立法過失形成的主要原因是成文法的滯后性以及我國(guó)立法體制下的多元立法模式。解決我國(guó)的立法過失問題需要擴(kuò)大立法提案的主體范圍,設(shè)立立法動(dòng)議常規(guī)調(diào)查機(jī)制;加強(qiáng)規(guī)范性文件的備案審查;提升地方立法質(zhì)量;發(fā)揮但又要限制司法解釋的作用;建立國(guó)家立法賠償機(jī)制等。
[Abstract]:The abstraction and lag of law make it unavoidable that various negligence phenomena appear in legislation. The existence of legislative negligence affects the perfection of legal system and the protection of civil rights. The main reasons for the formation of legislative negligence are the lag of statute law and the multi-legislative mode under the legislative system of our country. But it also restricts the role of judicial interpretation, and establishes national legislative compensation mechanism.
