【摘要】：依據(jù)漢代典型的"持質(zhì)"案例,結合相關研究,考察了漢代"持質(zhì)"法的演變和階段性特征。漢代"持質(zhì)"法可以分為四個歷史發(fā)展階段。漢初的"劫人"法是漢代"持質(zhì)"法發(fā)展的初級階段,特征是被劫持者的人身安全尚未成為立法的重要內(nèi)容。西漢中期官吏在處理"持質(zhì)"案件時,重視對犯罪分子進行說服教育,"持質(zhì)"法的實施呈現(xiàn)出人性化特征。東漢初期存在"持質(zhì)"法實施時不顧人質(zhì)生命安全的現(xiàn)象,"持質(zhì)"法表現(xiàn)出被強化的特征。東漢后期在處理"持質(zhì)"案時出現(xiàn)系列"贖質(zhì)"現(xiàn)象,但此時期某些官吏的果斷表現(xiàn)也讓"持質(zhì)"法彰顯了莊嚴與神圣。
[Abstract]:According to the typical case of "holding quality" in Han Dynasty, this paper studies the evolution and stage characteristics of "holding quality" method in Han Dynasty. The method of holding quality in Han Dynasty can be divided into four stages of historical development. The "robbing" law in the early Han Dynasty is the primary stage of the development of the "quality-holding" law in the Han Dynasty, which is characterized by the fact that the personal safety of the hijackers has not yet become an important part of the legislation. In the middle period of the Western Han Dynasty, the officials paid more attention to persuading and educating the criminals when dealing with the cases of "holding quality", and the implementation of the law of "holding quality" showed humanized characteristics. In the early Eastern Han Dynasty, there existed the phenomenon of "holding quality" law in disregard of the life safety of hostages, and the "holding quality" method showed the characteristics of being strengthened. In the late Eastern Han Dynasty, a series of "foreclosure" phenomena appeared when handling the case of "holding quality", but the decisive performance of some officials in this period also made the method of "holding quality" manifest the dignity and sanctity.
