【摘要】：自唐代律典正式設(shè)置"不應(yīng)(得)為"律始,至清代《大清律例》"不應(yīng)為"條的存在,作為兜底條款的"不應(yīng)為"律通過不斷增修新例以強(qiáng)化其"庶補(bǔ)遺闕""以德禮坊民"功能的實現(xiàn)。本文通過《大清律例》中有關(guān)"不應(yīng)為"條規(guī)定的律例梳理,對《刑案匯覽》《刑部比照加減成案》以及地方檔案的整理,發(fā)現(xiàn)該條在法律文本的規(guī)范與司法實踐中具體操作存在不一致的情形。這是統(tǒng)治者試圖賦予司法官員揣摩立法原意,準(zhǔn)確適用自由裁量權(quán),達(dá)到案件依其輕重處罰,實現(xiàn)司法公允。這種立法目的也是現(xiàn)今國家立法需不斷思考的問題。
[Abstract]:From the beginning of the formal establishment of "should not be" in the legal code of the Tang Dynasty to the existence of "should not be" in the Qing Dynasty, As a bottom clause, the law strengthens the realization of its function by adding new examples to strengthen its function of "supplementing the legacies" and "using the courtesy of the Fangmin". This article combs the laws and regulations concerning "not to be" in the "Qing Dynasty", and makes a review of the "Criminal cases Review", "the Ministry of torture adds and subtracts the case" and the arrangement of the local archives. It is found that there is inconsistency between the regulation of the legal text and the concrete operation in judicial practice. This is an attempt by the ruler to give judicial officials the right to understand the legislative intent, to apply discretion accurately, to punish the case according to its severity, and to realize judicial fairness. This kind of legislative purpose is also the current national legislation needs to be constantly pondered.
