【摘要】：本文以不孝罪的源流入手,首先以《刑案匯覽》有關真實案例為依據(jù),結合《大清律例》中具體行為類型的規(guī)定了解不孝罪的來源,并對不孝罪的具體條款進行了剖析,然后以唐律中不孝罪的規(guī)定為基本參照,分析清律中不孝罪與前朝的沿襲和繼承。最后簡單梳理和回顧了全文的大致脈絡,對不孝罪的變化所體現(xiàn)的道德與法律的變化趨勢進行了簡要概括�？梢哉f清律不孝罪在一定程度上也是繼承隋唐律法的,但是仍然存在著一些變化。
[Abstract]:This article starts with the origin of the crime of unfilial piety, first of all, based on the relevant real cases of the criminal case, combining with the provisions of the specific behavior types in the Qing Dynasty, to understand the source of the crime of unfilial piety, and to analyze the specific provisions of the crime of unfilial piety. Then, the article analyzes the inheritance and inheritance of the crime of unfilial piety in Qing Dynasty with the stipulation of the crime of unfilial piety in the law of Tang Dynasty as the basic reference. In the end, the author briefly combs and reviews the general context of the full text, and briefly generalizes the changing trend of morality and law embodied in the change of unfilial piety. It can be said that the crime of unfilial piety inherited the law of the Sui and Tang dynasties to some extent, but there are still some changes.
