【摘要】： 思想政治教育法治化是指在憲法和法律的范圍內(nèi)，建立和完善思想政治教育的法律、法規(guī)和制度體系，依法進(jìn)行思想政治教育活動(dòng)，使思想政治教育處于依法治理的狀態(tài)之中。思想政治教育法治化就是要使我國(guó)的思想政治教育制度化、規(guī)范化，具有可操作性和說(shuō)服力，增強(qiáng)思想政治教育的有效性，克服思想政治教育中的人治傾向和隨意化傾向，保護(hù)合法的思想道德自由。它是提高思想政治教育的有效性，充分發(fā)揮其“生命線”作用的保證，也是依法治國(guó)的客觀要求。思想政治教育法治化的研究在理論和實(shí)踐上對(duì)思想政治教育都是意義極其重大的。 本文從理論和實(shí)施兩個(gè)方面對(duì)思想政治教育法治化進(jìn)行了探討。首先從我國(guó)依法治國(guó)的基本國(guó)策、思想政治教育自身的可調(diào)控性和它的憲法法律基礎(chǔ)等方面論述了思想政治教育法治化的前提條件；接下來(lái)分別對(duì)思想政治教育法治化的必然性和可行性進(jìn)行了論證。思想政治教育法治化的必然性表現(xiàn)在它是社會(huì)主義市場(chǎng)經(jīng)濟(jì)的必然要求、社會(huì)主義主導(dǎo)意識(shí)的必然趨勢(shì)、社會(huì)主義政治文明的必然結(jié)果及其自身創(chuàng)新的必然結(jié)論等四個(gè)方面。思想政治教育法治化的可行性表現(xiàn)是在哲學(xué)、政治學(xué)、法律等各個(gè)領(lǐng)域都有它存在的可行性理論基礎(chǔ)。 本文把思想政治教育法治化的具體實(shí)施分為三個(gè)方面進(jìn)行研究，即思想政治教育內(nèi)容的法治化、實(shí)施手段的法治化和管理的法治化。在思想政治教育法治化的實(shí)施過程中，前提是要建立和完善思想政治教育內(nèi)容、實(shí)施手段和管理等各個(gè)方面的法律法規(guī)制度，使其有法可依，但關(guān)鍵是要嚴(yán)格依法進(jìn)行，，在進(jìn)行思想政治教育中以法律為準(zhǔn)、為上。思想政治教育法治化不是限制思想自由的枷鎖，而是限制人治、限制隨意、保護(hù)思想自由 西南交通大學(xué)碩士研究生學(xué)位論文 第OI 頁(yè) 的武器。對(duì)思想政治教育法治化具體實(shí)施的成敗評(píng)判，我們必須堅(jiān)持以“三 個(gè)代表”和人的全面發(fā)展這兩個(gè)標(biāo)準(zhǔn)。
[Abstract]:The legalization of ideological and political education refers to the establishment and perfection of the laws, regulations and systems of ideological and political education within the scope of the Constitution and the law, and the conduct of ideological and political education activities in accordance with the law, so as to make the ideological and political education in a state governed by the law. The legalization of ideological and political education is to institutionalize and standardize ideological and political education in our country, be operable and persuasive, enhance the effectiveness of ideological and political education, and overcome the tendency of rule by man and arbitrariness in ideological and political education. The feasibility of the rule of law in ideological and political education is the theoretical basis of its existence in philosophy, politics, law and other fields. In this paper, the concrete implementation of the rule of law of ideological and political education is divided into three aspects: the legalization of the content of ideological and political education, the legalization of the means of implementation and the legalization of management.
