【摘要】：在清代,經(jīng)過(guò)幾千年的演變,尤其經(jīng)過(guò)了唐、宋、元、明各代的發(fā)展,清代的關(guān)于家族內(nèi)部糾紛解決的建設(shè)更加完備,解決的糾紛范圍涉及家庭內(nèi)部和社會(huì)生活的多個(gè)方面,因此關(guān)于清代家族內(nèi)民事糾紛及其解決的研究也就更具有了代表意義。而目前關(guān)于該問(wèn)題的研究往往是在有關(guān)清代的訴訟制度及其訴訟文化時(shí)附帶地被提到,很少有人對(duì)此進(jìn)行過(guò)專(zhuān)門(mén)的研究,這也是促使本人對(duì)此加以研究的原因。通過(guò)對(duì)清代的家族內(nèi)民事糾紛解決的研究,是我們看待中國(guó)古代社會(huì)以及法律制度的一個(gè)很好的視角。 本文共分四個(gè)部分,第一部分對(duì)清代家族內(nèi)民事糾紛進(jìn)行分類(lèi),共分為分家析產(chǎn)糾紛；繼承糾紛；婚姻糾紛以及其他民事糾紛四類(lèi)。 第二部分對(duì)清代在解決家族內(nèi)民事糾紛所依據(jù)的理念進(jìn)行闡述,認(rèn)為清代在處理家族內(nèi)民事糾紛過(guò)程中通常都秉承著道德教化、平息訴訟；忍讓共存、保全族誼；維護(hù)綱常禮教三個(gè)理念。 第三部分對(duì)清代針對(duì)家族內(nèi)民事糾紛的具體解決進(jìn)行了分析。對(duì)清代關(guān)于家族內(nèi)民事糾紛解決的依據(jù)、一般程序以及具體方法進(jìn)行了分別論述。 第四部分對(duì)清代家族內(nèi)民事糾紛解決制度進(jìn)行了評(píng)價(jià),認(rèn)為清代家族內(nèi)民事糾紛解決制度不僅具有緩和國(guó)家矛盾,穩(wěn)定社會(huì)秩序；促進(jìn)家族和諧,維護(hù)人情關(guān)系；降低當(dāng)事人的矛盾解決成本等積極方面的意義,同時(shí)也具有阻礙人們?cè)V訟意識(shí)和權(quán)利意識(shí)的生成、我國(guó)近代訴訟程序化觀(guān)念的形成等方面的消極因素。
[Abstract]:In the Qing Dynasty, after thousands of years of evolution, especially after the development of the Tang, Song, Yuan and Ming dynasties, the Qing Dynasty's construction on the settlement of disputes within the family was more complete, and the scope of the dispute resolution involved many aspects of the family and social life. Therefore, the study on the civil disputes and their resolution in the Qing Dynasty has more representative significance. However, the current research on this issue is often mentioned incidental to the litigation system and its litigation culture in the Qing Dynasty, and few people have made a special study on it, which is also the reason why I study it. It is a good perspective for us to look at the ancient Chinese society and the legal system through the study of the settlement of civil disputes in the family in the Qing Dynasty. This paper is divided into four parts. The first part classifies the civil disputes in the Qing Dynasty into four categories: division of family disputes; inheritance disputes; marriage disputes; and other civil disputes. The second part of the Qing Dynasty in the settlement of civil disputes in the family on the basis of the concept that the Qing Dynasty in the process of dealing with civil disputes in the family are usually adhering to moral education to settle the litigation; Maintain the three principles of discipline and ethics. The third part analyzes the specific settlement of civil disputes in the Qing Dynasty. This paper discusses the basis, general procedure and specific methods of the settlement of civil disputes in the Qing Dynasty. The fourth part evaluates the civil dispute resolution system in the Qing Dynasty, and thinks that the civil dispute resolution system in the Qing Dynasty not only has the characteristics of easing the national contradiction, stabilizing the social order, promoting the family harmony, maintaining the human relationship. At the same time, it has the negative factors such as blocking the formation of people's litigation consciousness and right consciousness, forming the concept of procedural litigation in modern China, and so on.
