【摘要】：我國著作權(quán)法和信息網(wǎng)絡(luò)傳播權(quán)保護(hù)條例中所規(guī)定的圖書館例外條款較為簡陋,難以滿足圖書館事業(yè)的發(fā)展和著作權(quán)人權(quán)益的保護(hù)。美國版權(quán)法108條圖書館例外條款9款的規(guī)定繁復(fù)具體,是圖書館例外條款的重要代表,其規(guī)定基礎(chǔ)是具有美國版權(quán)法特色的107條合理使用制度。在我國著作權(quán)法第三次大規(guī)模修訂之際,借鑒美國版權(quán)法合理使用制度中的圖書館例外條款,對我國圖書館例外條款的補(bǔ)充和修訂有重要意義。
[Abstract]:The exception clauses of library stipulated in the copyright Law and the regulations on the Protection of the right of dissemination of Information Network in China are relatively simple and difficult to satisfy the development of the library cause and the protection of the rights and interests of the copyright owners. The nine sections of 108 library exceptions in American copyright law are the important representatives of the library exception clauses, which are based on 107 reasonable usage rules with the characteristics of American copyright law. At the time of the third large-scale revision of copyright law in China, it is of great significance to supplement and revise the library exception clause of our country by referring to the library exception clause in the rational use system of American copyright law.
