【摘要】：本文采用比較研究的方法,在仔細(xì)研讀前人關(guān)于行政指導(dǎo)比較研究著作的基礎(chǔ)上,對(duì)中國(guó)和日本兩個(gè)國(guó)家的行政指導(dǎo)制度就其產(chǎn)生的背景、理論知識(shí)基礎(chǔ),兩國(guó)對(duì)行政指導(dǎo)概念以及性質(zhì)的相關(guān)觀點(diǎn)、以及行政指導(dǎo)在中國(guó)和日本兩國(guó)各自的立法實(shí)踐活動(dòng)和具體指導(dǎo)活動(dòng),進(jìn)行了一個(gè)相對(duì)細(xì)致的對(duì)比分析。在此基礎(chǔ)上對(duì)兩國(guó)學(xué)術(shù)界就行政指導(dǎo)相關(guān)理論的異同進(jìn)行了一些總結(jié)工作,并對(duì)有所爭(zhēng)議的部分提出了一些自己的看法,認(rèn)為研究的立場(chǎng)不應(yīng)拘泥于過(guò)于絕對(duì)的角度,要有統(tǒng)籌全局的目光,來(lái)對(duì)具體問(wèn)題進(jìn)行具體分析。同時(shí)對(duì)我國(guó)行政指導(dǎo)制度的完善,從行為依據(jù)、程序設(shè)計(jì)、法律責(zé)任、救濟(jì)制度等幾個(gè)方面,來(lái)進(jìn)行具體的闡述,希望可以為我國(guó)行政指導(dǎo)制度的完善提供一些思路。
[Abstract]:On the basis of careful study of the previous works on comparative research of administrative guidance, this paper uses the method of comparative study to analyze the background and theoretical knowledge of the administrative guidance system of China and Japan. The two countries make a comparative analysis of the concept and nature of administrative guidance, as well as their respective legislative practice and specific guidance activities in China and Japan. On this basis, this paper summarizes the similarities and differences of the relevant theories of administrative guidance between the academic circles of the two countries, and puts forward some views on the controversial parts, and thinks that the research position should not be confined to the angle of too absolute. Must have the overall plan overall situation vision, carries on the concrete analysis to the concrete question. At the same time, the perfection of our country's administrative guidance system, from the behavior basis, the procedure design, the legal responsibility, the relief system and so on several aspects, carries on the concrete elaboration, hopes to provide some ideas for our country's administrative guidance system consummation.
