美國(guó)版權(quán)管理規(guī)制研究

【摘要】：隨著知識(shí)經(jīng)濟(jì)的迅猛發(fā)展,知識(shí)產(chǎn)權(quán)的重要性日益彰顯。版權(quán)作為知識(shí)產(chǎn)權(quán)的重要組成部分,在知識(shí)經(jīng)濟(jì)的結(jié)構(gòu)中發(fā)揮了巨大的作用。版權(quán)對(duì)國(guó)家和個(gè)人都產(chǎn)生了深遠(yuǎn)的影響,既能保護(hù)創(chuàng)造性的勞動(dòng)成果,又能鼓勵(lì)創(chuàng)新,為個(gè)人乃至整個(gè)社會(huì)帶來(lái)巨大的經(jīng)濟(jì)價(jià)值。對(duì)版權(quán)管理規(guī)制的研究,有助于我們更好地學(xué)習(xí)和運(yùn)用版權(quán)法律,在平時(shí)的學(xué)習(xí)和工作中培養(yǎng)版權(quán)保護(hù)意識(shí)。美國(guó)擁有國(guó)際領(lǐng)先的版權(quán)管理法規(guī)和完善的版權(quán)管理機(jī)制,其中有很多經(jīng)驗(yàn)值得我們借鑒。美國(guó)版權(quán)管理法規(guī)的特點(diǎn)是立法速度快,保護(hù)范圍廣泛,它能緊跟時(shí)代步伐,及時(shí)做出調(diào)整。美國(guó)擁有完善的版權(quán)管理制度,美國(guó)版權(quán)局從版權(quán)作品的完成開(kāi)始,提供一系列的版權(quán)登記工作,美國(guó)版權(quán)法也對(duì)版權(quán)的管理的各個(gè)方面做了詳細(xì)的規(guī)定。中美兩國(guó)在國(guó)際貿(mào)易領(lǐng)域的爭(zhēng)端大都是由于知識(shí)產(chǎn)權(quán)的糾紛引起的,對(duì)兩國(guó)版權(quán)管理的法規(guī)及制度進(jìn)行研究,有助于歸納兩國(guó)版權(quán)管理規(guī)制的差異,對(duì)我國(guó)版權(quán)管理現(xiàn)狀進(jìn)行客觀的把握和分析。 本文的第一部分對(duì)論文的研究背景、研究意義、研究現(xiàn)狀、研究目標(biāo)、內(nèi)容與特色進(jìn)行了闡述；第二部分介紹了美國(guó)版權(quán)法和版權(quán)管理的歷史進(jìn)程和相關(guān)組織；第三部分對(duì)美國(guó)版權(quán)管理的相關(guān)法律、美國(guó)版權(quán)局和版稅仲裁所的法律規(guī)定、美國(guó)近期有關(guān)版權(quán)管理法規(guī)的修訂進(jìn)行了評(píng)析；第四部分研究了美國(guó)版權(quán)的標(biāo)記、注冊(cè)、許可、轉(zhuǎn)讓和終止制度；第五部分對(duì)中美的版權(quán)管理法規(guī)和制度進(jìn)行了對(duì)比研究,對(duì)我國(guó)的版權(quán)管理規(guī)制提出建議；第六部分對(duì)全文進(jìn)行了總結(jié)。本文的研究方法是綜合分析法和對(duì)比分析法,對(duì)美國(guó)近十年版權(quán)管理法規(guī)的修訂進(jìn)行了綜合分析,對(duì)中美版權(quán)管理法規(guī)和制度進(jìn)行了對(duì)比研究。本文的研究特色是通過(guò)對(duì)大量的英文原文材料進(jìn)行分析,從而對(duì)美國(guó)版權(quán)管理法規(guī)與制度進(jìn)行研究。本文研究主線是通過(guò)對(duì)美國(guó)版權(quán)管理法規(guī)與制度的分析,進(jìn)行中美版權(quán)管理規(guī)制的對(duì)比研究,從而對(duì)完善我國(guó)版權(quán)管理機(jī)制提出意見(jiàn)和建議。
[Abstract]:With the rapid development of knowledge economy, the importance of intellectual property is becoming more and more obvious. As an important part of intellectual property, copyright plays an important role in the structure of knowledge economy. Copyright has a profound influence on the country and the individual. It can not only protect the creative labor achievements, but also encourage innovation, and bring great economic value to the individual and the whole society. The study on the regulation of copyright management will help us to study and apply copyright law better and cultivate the consciousness of copyright protection in our normal study and work. The United States has international leading copyright management regulations and perfect copyright management mechanism, among which there are many experiences that we should learn from. The characteristic of American copyright management law is that it is fast in legislation and wide in scope of protection, it can keep up with the times and make adjustments in time. The United States has a sound copyright management system, the United States copyright Office from the completion of copyright works, provide a series of copyright registration work, the United States copyright law also made a detailed regulation of all aspects of copyright management. Most of the disputes between China and the United States in the field of international trade are caused by disputes over intellectual property rights. To study the laws and regulations of copyright management between the two countries is helpful to sum up the differences between the two countries in the regulation of copyright management. To our country copyright management present situation carries on the objective grasp and the analysis. The first part of this paper describes the research background, research significance, research status, research objectives, content and characteristics of the paper, the second part introduces the historical process and related organizations of copyright law and copyright management in the United States. The third part reviews the relevant laws of copyright management in the United States, the laws and regulations of the United States copyright Administration and the copyright Arbitration Institute, and the recent revision of copyright management regulations in the United States. The fourth part studies the marking, registration and licensing of copyright in the United States. The fifth part makes a comparative study on the laws and regulations of copyright management in China and the United States, and puts forward some suggestions on the regulation of copyright management in China. The sixth part summarizes the full text. The research methods of this paper are comprehensive analysis and comparative analysis. The revision of copyright management laws and regulations in the United States in the past ten years is comprehensively analyzed, and a comparative study is made on the laws and regulations of copyright management in China and the United States. The research features of this paper are to analyze a large number of English original materials, so as to study the laws and regulations of copyright management in the United States. The main line of this paper is to make a comparative study on the regulation of copyright management between China and the United States through the analysis of the laws and regulations of copyright management in the United States, so as to put forward some suggestions and suggestions on how to perfect the mechanism of copyright management in China.
