【摘要】：隨著知識經(jīng)濟的迅猛發(fā)展,知識產(chǎn)權(quán)的重要性日益彰顯。版權(quán)作為知識產(chǎn)權(quán)的重要組成部分,在知識經(jīng)濟的結(jié)構(gòu)中發(fā)揮了巨大的作用。版權(quán)對國家和個人都產(chǎn)生了深遠的影響,既能保護創(chuàng)造性的勞動成果,又能鼓勵創(chuàng)新,為個人乃至整個社會帶來巨大的經(jīng)濟價值。對版權(quán)管理規(guī)制的研究,有助于我們更好地學(xué)習(xí)和運用版權(quán)法律,在平時的學(xué)習(xí)和工作中培養(yǎng)版權(quán)保護意識。美國擁有國際領(lǐng)先的版權(quán)管理法規(guī)和完善的版權(quán)管理機制,其中有很多經(jīng)驗值得我們借鑒。美國版權(quán)管理法規(guī)的特點是立法速度快,保護范圍廣泛,它能緊跟時代步伐,及時做出調(diào)整。美國擁有完善的版權(quán)管理制度,美國版權(quán)局從版權(quán)作品的完成開始,提供一系列的版權(quán)登記工作,美國版權(quán)法也對版權(quán)的管理的各個方面做了詳細的規(guī)定。中美兩國在國際貿(mào)易領(lǐng)域的爭端大都是由于知識產(chǎn)權(quán)的糾紛引起的,對兩國版權(quán)管理的法規(guī)及制度進行研究,有助于歸納兩國版權(quán)管理規(guī)制的差異,對我國版權(quán)管理現(xiàn)狀進行客觀的把握和分析。 本文的第一部分對論文的研究背景、研究意義、研究現(xiàn)狀、研究目標、內(nèi)容與特色進行了闡述；第二部分介紹了美國版權(quán)法和版權(quán)管理的歷史進程和相關(guān)組織；第三部分對美國版權(quán)管理的相關(guān)法律、美國版權(quán)局和版稅仲裁所的法律規(guī)定、美國近期有關(guān)版權(quán)管理法規(guī)的修訂進行了評析；第四部分研究了美國版權(quán)的標記、注冊、許可、轉(zhuǎn)讓和終止制度；第五部分對中美的版權(quán)管理法規(guī)和制度進行了對比研究,對我國的版權(quán)管理規(guī)制提出建議；第六部分對全文進行了總結(jié)。本文的研究方法是綜合分析法和對比分析法,對美國近十年版權(quán)管理法規(guī)的修訂進行了綜合分析,對中美版權(quán)管理法規(guī)和制度進行了對比研究。本文的研究特色是通過對大量的英文原文材料進行分析,從而對美國版權(quán)管理法規(guī)與制度進行研究。本文研究主線是通過對美國版權(quán)管理法規(guī)與制度的分析,進行中美版權(quán)管理規(guī)制的對比研究,從而對完善我國版權(quán)管理機制提出意見和建議。
[Abstract]:With the rapid development of knowledge economy, the importance of intellectual property is becoming more and more obvious. As an important part of intellectual property, copyright plays an important role in the structure of knowledge economy. Copyright has a profound influence on the country and the individual. It can not only protect the creative labor achievements, but also encourage innovation, and bring great economic value to the individual and the whole society. The study on the regulation of copyright management will help us to study and apply copyright law better and cultivate the consciousness of copyright protection in our normal study and work. The United States has international leading copyright management regulations and perfect copyright management mechanism, among which there are many experiences that we should learn from. The characteristic of American copyright management law is that it is fast in legislation and wide in scope of protection, it can keep up with the times and make adjustments in time. The United States has a sound copyright management system, the United States copyright Office from the completion of copyright works, provide a series of copyright registration work, the United States copyright law also made a detailed regulation of all aspects of copyright management. Most of the disputes between China and the United States in the field of international trade are caused by disputes over intellectual property rights. To study the laws and regulations of copyright management between the two countries is helpful to sum up the differences between the two countries in the regulation of copyright management. To our country copyright management present situation carries on the objective grasp and the analysis. The first part of this paper describes the research background, research significance, research status, research objectives, content and characteristics of the paper, the second part introduces the historical process and related organizations of copyright law and copyright management in the United States. The third part reviews the relevant laws of copyright management in the United States, the laws and regulations of the United States copyright Administration and the copyright Arbitration Institute, and the recent revision of copyright management regulations in the United States. The fourth part studies the marking, registration and licensing of copyright in the United States. The fifth part makes a comparative study on the laws and regulations of copyright management in China and the United States, and puts forward some suggestions on the regulation of copyright management in China. The sixth part summarizes the full text. The research methods of this paper are comprehensive analysis and comparative analysis. The revision of copyright management laws and regulations in the United States in the past ten years is comprehensively analyzed, and a comparative study is made on the laws and regulations of copyright management in China and the United States. The research features of this paper are to analyze a large number of English original materials, so as to study the laws and regulations of copyright management in the United States. The main line of this paper is to make a comparative study on the regulation of copyright management between China and the United States through the analysis of the laws and regulations of copyright management in the United States, so as to put forward some suggestions and suggestions on how to perfect the mechanism of copyright management in China.
