【摘要】：集團(tuán)仲裁是美國(guó)為消費(fèi)者、雇傭、金融等格式合同的弱方當(dāng)事人集合維權(quán)創(chuàng)設(shè)的一種糾紛解決方式。美國(guó)最高法院有關(guān)集團(tuán)仲裁里程碑的判例,構(gòu)成了該制度最重要的法律淵源,盡管法院對(duì)集團(tuán)仲裁的態(tài)度在支持與限制之間猶豫不定,但是其仍然得到了廣泛應(yīng)用,同時(shí)還有許多問(wèn)題尚待解決。我國(guó)對(duì)該制度應(yīng)保持密切關(guān)注的態(tài)度,等時(shí)機(jī)成熟時(shí)可以考慮引進(jìn)該制度。
[Abstract]:Group arbitration is a kind of dispute resolution method created by the weak parties in the form of consumer, employment, finance and so on in the United States. The landmark jurisprudence of the United States Supreme Court constitutes the most important legal source of the system. Although the court's attitude towards group arbitration is hesitant between support and limitation, it is still widely used. At the same time, there are still many problems to be solved. Our country should pay close attention to the system and introduce it when the time is ripe.
