區(qū)域法治指數(shù)量化評估研究

【摘要】：法治是國家治理的基礎和基本方式。隨著我國法治進程的逐步深入,作為兼具約束及激勵功能的管理工具與技術手段,法治評估愈來愈得到實務界與學術界的高度重視。隨著世界各國或地區(qū)法治進程的不斷推進,很多區(qū)域都在探索法治量化評估的道路。各個區(qū)域通過把法治指數(shù)量化,變抽象的法治概念為具體的法治指數(shù),通過直觀數(shù)據(jù)的對比分析,以此來衡量和評價國家或地區(qū)的法治發(fā)展水平。法治量化評估作為法治研究的一種新方式,其涵蓋的范圍極其寬泛,建立一套科學的法治量化評估體系則是進行法治量化評估的必要保障。近年來,我國法治建設和法治理論研究成果顯著,關于法治量化評估的實證研究也取得了長足發(fā)展。在借鑒其它國家或地區(qū)的法治評估實踐經(jīng)驗的基礎之上,我國的法治量化探索之路更需要立足國情,構建具有中國特色的法治量化評估指標體系。江蘇省是全國較早探索法治量化評估之路的省份之一,并制定了一系列具有本土特色的法治量化評估體系,并且在實踐中探索出了一套具有可操作性的考核評估方法,在全國具有可復制、可推廣的示范價值�；谥袊姆ㄖ瘟炕u估指標體系的構建和法治定量化評估仍在探索的過程中,因此,總結江蘇經(jīng)驗,發(fā)現(xiàn)其存在的問題,完善其區(qū)域法治評估體系,以此來提升法治評估的效度與可信度。通過提升區(qū)域法治評估的實踐成效,進而有效地推進法治江蘇建設,為法治中國建設的理論與實踐提供典型樣本。
[Abstract]:Rule of law is the foundation and basic way of national governance. With the gradual deepening of the process of rule of law in our country, as a management tool and technical means with both constraints and incentive functions, the evaluation of rule of law has been paid more and more attention by the practical and academic circles. With the advancement of the process of rule of law in many countries and regions, many regions are exploring the way of quantitative evaluation of rule of law. By quantifying the index of the rule of law and changing the abstract concept of the rule of law into the concrete index of the rule of law, each region measures and evaluates the level of the development of the rule of law in a country or region through the contrast and analysis of the intuitionistic data. As a new way to study the rule of law, the quantitative evaluation of the rule of law covers a wide range, and the establishment of a scientific system of quantitative evaluation of the rule of law is the necessary guarantee for the quantitative evaluation of the rule of law. In recent years, there have been remarkable achievements in the construction of the rule of law and the theory of the rule of law, and the empirical research on the quantitative evaluation of the rule of law has also made great progress. On the basis of drawing lessons from the practical experience of other countries or regions in the evaluation of the rule of law, it is necessary to establish a quantitative evaluation index system of the rule of law with Chinese characteristics on the basis of the national conditions and the way to explore the quantification of the rule of law in our country. Jiangsu Province is one of the provinces that explored the way of quantitative evaluation of the rule of law earlier in the country, and has formulated a series of quantitative evaluation system of the rule of law with local characteristics, and has explored a set of operable assessment methods in practice. It has the demonstration value of replicating and popularizing in the whole country. The construction of quantitative evaluation index system of rule of law and the quantitative evaluation of rule of law based on China are still in the process of exploration. Therefore, summing up the experience of Jiangsu, finding out the existing problems, perfecting its regional evaluation system of rule of law, In order to enhance the validity and credibility of the rule of law evaluation. By improving the practical effect of regional evaluation of rule of law, we can effectively promote the construction of Jiangsu under the rule of law, and provide a typical sample for the theory and practice of the construction of ruled by law in China.
