【摘要】：“德治”與“法治”是人類在治理國家中總結(jié)出來的兩種不可分離的治理模式,也是人類治理國家的兩種根本手段。但是在人類的治理實(shí)踐中,在對“德治”與“法治”關(guān)系的認(rèn)識中,存在著許多模糊的甚至錯(cuò)誤的思想,存在“或重德輕法”,“或重法輕德”的現(xiàn)象,嚴(yán)重地影響和制約了社會(huì)良好治理,阻礙了人類美好社會(huì)的價(jià)值追求、公平正義的社會(huì)理想的實(shí)現(xiàn)。 有鑒于此,本文以“德治”與“法治”思想的產(chǎn)生和演變的事實(shí)考察為出發(fā)點(diǎn),在國內(nèi)外經(jīng)典作家對“德治”與“法治”關(guān)系理論的研究為基礎(chǔ)上,在全面分析中國“德治”與“法治”的歷史進(jìn)程和哲學(xué)思考的基礎(chǔ)上,通過對中國社會(huì)發(fā)展的現(xiàn)實(shí)考察和歷史經(jīng)驗(yàn)的總結(jié),得出要實(shí)現(xiàn)一個(gè)國家的良好治理,必須做到“德治”與“法治”的有機(jī)結(jié)合,才能實(shí)現(xiàn)社會(huì)的良好治理,并提出“德治”與“法治”實(shí)現(xiàn)整合的理論思考。
[Abstract]:"Rule by virtue" and "rule by law" are two kinds of inseparable governance models summarized by human beings in governing the country, and they are also two basic means of human governance. However, in the practice of human governance, in the understanding of the relationship between "rule by virtue" and "rule by law", there are many vague and even erroneous ideas, such as "attaching importance to virtue and neglecting law", or "attaching importance to law and neglecting morality". It seriously affects and restricts the good governance of the society, hinders the pursuit of human value and the realization of the social ideal of fairness and justice. In view of this, based on the fact investigation of the emergence and evolution of the thought of "rule of virtue" and "rule of law", and on the basis of the research on the theory of the relationship between "rule of virtue" and "rule by law" by classical writers at home and abroad, On the basis of comprehensive analysis of the historical process and philosophical thinking of "rule by virtue" and "rule of law" in China, through the realistic investigation and historical experience of China's social development, it is concluded that a good governance of a country should be realized. It is necessary to combine "rule by virtue" with "rule by law" in order to realize the good governance of society, and put forward the theoretical thinking of the integration of "rule by virtue" and "rule by law".
