【摘要】：確立依法治國(guó)、建設(shè)社會(huì)主義法治國(guó)家的治國(guó)思路,是改革開(kāi)放以來(lái)我國(guó)法學(xué)政治學(xué)研究取得的最重要成果。作為一種治國(guó)的方法或者文明的狀態(tài),法治所確立的理念和原則已經(jīng)得到了普遍的認(rèn)同,建立法治社會(huì)是絕大多數(shù)國(guó)家的目標(biāo)。圍繞建設(shè)法治社會(huì)這個(gè)問(wèn)題,本文探討了法治社會(huì)的價(jià)值追求,其與民主政治、市場(chǎng)經(jīng)濟(jì)和信息社會(huì)的聯(lián)系,以及政府信息公開(kāi)制度與以上問(wèn)題的關(guān)系。經(jīng)過(guò)分析本文認(rèn)為,政府信息公開(kāi)制度是建設(shè)法治社會(huì)的內(nèi)在要求,而該制度的建立對(duì)于法治社會(huì)的建成具有巨大的推動(dòng)作用。我國(guó)應(yīng)盡早建立完善的政府信息公開(kāi)制度,以推動(dòng)法治社會(huì)的建設(shè),實(shí)現(xiàn)國(guó)家、社會(huì)和個(gè)人的均衡和諧 本文分為四個(gè)部分： 第一部分,概述。明確法治社會(huì)和政府信息公開(kāi)的概念,試闡明法治社會(huì)的價(jià)值要求以及政府信息公開(kāi)的沿革。 第二部分,從公民知情權(quán)和民主參與,社會(huì)契約理論和制度經(jīng)濟(jì)學(xué)理論角度分析法治社會(huì)和政府信息公開(kāi)的關(guān)系。 第三部分,對(duì)我國(guó)信息公開(kāi)制度的概述。分析在我國(guó)這樣尚未建成的法治社會(huì)中政府信息公開(kāi)制度的成就和缺點(diǎn)。 第四部分,略論政府信息公開(kāi)制度的建構(gòu)。
[Abstract]:It is the most important achievement in the research of law politics since the reform and opening up to establish the idea of governing the country by law and building a socialist country ruled by law. As a method of governing a country or a state of civilization, the concept and principle established by the rule of law have been universally accepted, and the goal of most countries is to establish a society ruled by law. Focusing on the problem of building a society ruled by law, this paper discusses the value pursuit of a society ruled by law, its relationship with democratic politics, market economy and information society, and the relationship between the open system of government information and the above problems. Through the analysis of this paper, it is concluded that the system of government information disclosure is the inherent requirement of building a society ruled by law, and the establishment of this system has a great role in promoting the establishment of a society ruled by law. Our country should establish the perfect government information open system as soon as possible, in order to promote the construction of the society ruled by law, realize the balance and harmony of the country, the society and the individual this article is divided into four parts: the first part, the summary. This paper clarifies the concept of rule of law society and government information disclosure, and tries to clarify the value requirements of the rule of law society and the history of government information disclosure. The second part analyzes the relationship between the rule of law society and the disclosure of government information from the perspective of citizen's right to know and democratic participation, social contract theory and institutional economics theory. The third part is an overview of the information disclosure system in China. This paper analyzes the achievements and shortcomings of the government information disclosure system in the society of rule of law which has not been completed in our country. The fourth part discusses the construction of government information disclosure system.
