【摘要】：民法典編纂需要正視習(xí)慣立法問(wèn)題,以習(xí)慣法作為相應(yīng)規(guī)范設(shè)計(jì)的參考依據(jù)。我國(guó)臺(tái)灣地區(qū)對(duì)祭祀公業(yè)和合會(huì)習(xí)慣立法的經(jīng)驗(yàn)可資參考。祭祀公業(yè)和合會(huì)習(xí)慣自身存在的問(wèn)題,催生了對(duì)于兩者的立法。我國(guó)臺(tái)灣地區(qū)通過(guò)制定特別條例的方式,完成了對(duì)祭祀公業(yè)的立法。而對(duì)合會(huì)的立法,則由其"民法"債編修訂直接完成。但是,兩者立法也引發(fā)了進(jìn)一步的問(wèn)題。民法典各分編編纂應(yīng)慎重對(duì)待既存習(xí)慣法,習(xí)慣立法應(yīng)尊重人民對(duì)于相關(guān)習(xí)慣法的法的確信,開(kāi)展一定的習(xí)慣調(diào)查。
[Abstract]:The compilation of civil code needs to face up to the problem of customary legislation and take customary law as the reference for the design of relevant norms. The experience of the customary legislation of sacrifice to public property and society in Taiwan area can be used for reference. The problem of sacrificing the public karma and the society itself gave birth to the legislation of the two. In Taiwan, the legislation on sacrificial public works was completed by making special regulations. And the legislation of the society is directly completed by the debt compilation and revision of its Civil Code. However, the two legislation also raises further problems. In the compilation of the Civil Code, the existing customary law should be treated with caution, and the customary legislation should respect the people's conviction of the relevant customary law and carry out a certain customary investigation.
