【摘要】：德法治理模式作為影響全人類的治理選擇,是馬克思主義法學(xué)關(guān)注的基本命題之一。德法治理選擇來源于順應(yīng)時(shí)勢要求的規(guī)則取舍和主輔規(guī)則之間的兼容空間。習(xí)近平總書記提出的依法治國與以德治國相結(jié)合思想,是契合時(shí)代趨勢的基本要求的法主德輔模式,也是中華民族法治史上德法治理模式的新型階段。從唯物史觀揭示的社會(huì)發(fā)展規(guī)律來觀照,德法走向一體化將成為社會(huì)趨勢,"道德法"將成為規(guī)則手段演化的必然選項(xiàng)。作為這種趨勢的上層反映,國家法治思想應(yīng)順應(yīng)時(shí)勢,適時(shí)取舍,提出全面法治的戰(zhàn)略思想。
[Abstract]:The governing mode of German and French as a choice to influence all mankind is one of the basic propositions of the law of Marx. The choice of the governance of Germany and France comes from the compatible space between the rules and the rules of the main and auxiliary rules that conform to the demand of the current situation. The combination of the rule of law and the rule of virtue, which is proposed by general secretary Xi Jinping, is in accordance with the trend of the times. It is also a new stage of the German and German governance in the rule of law in the history of the Chinese nation. From the rule of social development revealed by the historical materialism, the integration of Germany and France will become a social trend, and the moral law will be the inevitable choice for the evolution of the rule means. As the upper reflection of this trend, the state rule of law thought We should adapt to the current situation and make timely choice, and put forward the strategic thinking of a comprehensive rule of law.
