【摘要】："重刑輕民"一直是中國傳統(tǒng)法律的一大特點。"重刑輕民"不僅在立法上表現(xiàn)為法典的刑事化,在司法方面表現(xiàn)為刑法的刑罰化和民法的刑罰化,而且還在律學上表現(xiàn)出了律學的刑名化。本文在闡述"重刑輕民"表現(xiàn)的基礎上對其形成的原因做了一定的探討。雖然法治文明已經(jīng)發(fā)展到今天,但"重刑輕民"的傳統(tǒng)對我們的法治建設仍然存在一定影響,所以有必要對"重刑輕民"進行研究。
[Abstract]:Heavy punishment and neglecting the people has always been a major feature of Chinese traditional law. " "heavy punishment and light people" is not only the criminal law in the legislation, the criminal law and the civil law in the judicial aspect, but also the criminal name in the law. On the basis of expounding the performance of heavy punishment and neglecting the people, this paper probes into the causes of its formation. Although the civilization of rule of law has developed to today, the tradition of "heavy punishment neglects the people" still has certain influence on the construction of our rule of law, so it is necessary to study "heavy punishment neglects the people".
