【摘要】：國(guó)際貿(mào)易作為一種國(guó)家間的經(jīng)濟(jì)活動(dòng)，有別于國(guó)內(nèi)的經(jīng)濟(jì)活動(dòng)，其中尤為明顯的特點(diǎn)就是主權(quán)國(guó)家的政府對(duì)貿(mào)易活動(dòng)的種種管理及其影響。這種管理和影響，可能是消極的但有時(shí)是必要的。 哈薩克斯坦是中國(guó)在中亞各國(guó)的第一大貿(mào)易伙伴。近年來，哈薩克斯坦面對(duì)貿(mào)易自由化的浪潮，制定了一系列貿(mào)易管制立法和政策，以期減少貿(mào)易自由化給其帶來的不利影響。這些貿(mào)易管制措施，為我國(guó)同哈國(guó)貿(mào)易的相關(guān)企業(yè)帶來了種種貿(mào)易障礙。本文訴求于國(guó)際經(jīng)濟(jì)法視角，試圖就哈薩克斯坦外貿(mào)管制相關(guān)的法律制度進(jìn)行梳理，通過對(duì)哈薩克斯坦外貿(mào)管制措施的分析，為同哈國(guó)進(jìn)行貿(mào)易的我國(guó)企業(yè)以及中哈邊境貿(mào)易提出一些可行性的意見和建議，這也是本文的現(xiàn)實(shí)意義之所在。 本文運(yùn)用歸納與綜合的邏輯分析方法，著重分析哈白俄關(guān)稅同盟后哈國(guó)貿(mào)易管制的發(fā)展現(xiàn)狀，重點(diǎn)評(píng)析哈國(guó)貿(mào)易管理措施對(duì)中哈貿(mào)易造成的影響，將哈國(guó)與貿(mào)易管制有關(guān)的法律法規(guī)盡可能進(jìn)行詳盡的分析，明確哈國(guó)在管理中哈貿(mào)易中的主要外貿(mào)管理措施所引起的貿(mào)易障礙，，為中哈邊境貿(mào)易及我國(guó)企業(yè)提出一些相應(yīng)的規(guī)避哈國(guó)貿(mào)易障礙的法律建議，并呼吁在雙邊體制下更好地促進(jìn)中哈之間的貿(mào)易合作。
[Abstract]:As a kind of economic activity between countries, international trade is different from domestic economic activities, among which the most obvious characteristic is the management and influence of sovereign governments on trade activities. Such management and influence may be negative but sometimes necessary. Kazakhstan is China's largest trading partner in Central Asia. In recent years, in the face of the tide of trade liberalization, Kazakhstan has formulated a series of trade control legislation and policies in order to reduce the adverse effects of trade liberalization. These trade control measures have brought a variety of trade barriers to the related enterprises of our country's trade with Kazakhstan. From the perspective of international economic law, this paper tries to sort out the relevant legal system of Kazakhstan's foreign trade control, and through the analysis of Kazakhstan's foreign trade control measures, This paper puts forward some feasible suggestions and suggestions for the Chinese enterprises engaged in trade with Kazakhstan and the border trade between China and Kazakhstan, which is also the practical significance of this paper. In this paper, by means of inductive and comprehensive logic analysis, the author emphatically analyzes the current situation of Kazakhstan's trade control after the Russian and Kazakh customs union, and analyzes the impact of Kazakhstan's trade management measures on Sino-Kazakh trade. To make as detailed an analysis as possible of Kazakhstan's laws and regulations related to trade control, and to clarify the trade obstacles caused by the major foreign trade management measures of Kazakhstan in the management of Sino-Kazakh trade. This paper puts forward some legal suggestions for Sino-Kazakh border trade and Chinese enterprises to circumvent the obstacles to trade in Kazakhstan, and calls for a better trade cooperation between China and Kazakhstan under the bilateral system.
