【摘要】：快播案和網(wǎng)約車(chē)營(yíng)運(yùn)等案反映了技術(shù)創(chuàng)新突破了原有法律規(guī)定的限制,形成了技術(shù)在前面跑,法律在后面緊追的局面,造成了治理難題,而學(xué)界對(duì)這個(gè)問(wèn)題多從利益衡量方面考量,少有從法律方面、特別是從法律應(yīng)如何回應(yīng)技術(shù)進(jìn)步方面來(lái)研究這個(gè)問(wèn)題。從法律—技術(shù)角度切入,技術(shù)創(chuàng)新將給法律規(guī)則和法律理念這兩方面帶來(lái)改變,在法律規(guī)則上,以技術(shù)中立原則為理論支點(diǎn),可以把這個(gè)問(wèn)題分解成是否具有實(shí)質(zhì)性非侵權(quán)用途和平臺(tái)是否具有監(jiān)管責(zé)任這兩方面。在法律理念上,應(yīng)由壓制型法轉(zhuǎn)向回應(yīng)型法,才能更好地回應(yīng)技術(shù)的進(jìn)步。當(dāng)前的現(xiàn)狀是法律理念正在壓制型法和回應(yīng)型法之間搖擺,學(xué)界要發(fā)揮引領(lǐng)作用,推動(dòng)法律理念的進(jìn)步和轉(zhuǎn)變。
[Abstract]:The cases in which the technology innovation breaks through the limitations of the original law are reflected in the cases of the technology innovation and the operation of the net about the operation of the car. From the perspective of law and technology, technological innovation will bring changes to the two aspects of legal rules and legal ideas. In legal rules, the principle of technology neutrality is the theoretical fulcrum, which can be divided into two aspects: whether there are substantive non tort uses and whether the platform has regulatory responsibility. In the concept of law, it is necessary to change from the repressive law to the response law so as to better respond to the progress of the technology. The current situation is that the legal concept is swinging between the repressive and the response laws. The academic circles should play a leading role in promoting the progress and transformation of the legal concept.
