【摘要】：抗日戰(zhàn)爭(zhēng)作為中華民國(guó)的其中一個(gè)階段,在民國(guó)時(shí)期乃至歷史上都有著舉足輕重的作用,當(dāng)時(shí)的社會(huì)戰(zhàn)亂紛紛,局勢(shì)紊亂,正是在如此背景之下,國(guó)民政府通過(guò)制定各種法律法規(guī)及方針政策大力開(kāi)發(fā)礦產(chǎn)資源,嚴(yán)格管控礦業(yè)用地,以供戰(zhàn)時(shí)所需。該時(shí)期的礦業(yè)用地相關(guān)法律多是從抗戰(zhàn)前中華民國(guó)的礦業(yè)用地法發(fā)展演變而來(lái),以《中華民國(guó)礦業(yè)法》及其配套法律為基礎(chǔ),不斷修正,同時(shí)輔以制定一系列的礦業(yè)用地法律法規(guī)政策,對(duì)礦業(yè)用地作出具體規(guī)定與相繼調(diào)整,逐步形成了抗戰(zhàn)時(shí)期的礦業(yè)用地法律制度。本文以中華民國(guó)作為大背景,對(duì)抗戰(zhàn)時(shí)期的礦業(yè)用地法律制度進(jìn)行了深入研究和分析,再現(xiàn)該時(shí)期礦業(yè)用地法律制度的演變及發(fā)展歷程。筆者首先通過(guò)對(duì)抗戰(zhàn)時(shí)期礦業(yè)用地法律制度的時(shí)代背景、演變過(guò)程、立法體系等進(jìn)行詳細(xì)梳理,然后在此基礎(chǔ)上,重點(diǎn)解讀礦業(yè)用地的基本概念、礦業(yè)用地取得機(jī)制和礦業(yè)用地退出機(jī)制、礦業(yè)用地糾紛解決機(jī)制等內(nèi)容,并對(duì)其制定內(nèi)容和實(shí)施效果進(jìn)行客觀評(píng)價(jià)。歷史是一面鏡子,通過(guò)對(duì)抗日戰(zhàn)爭(zhēng)這一特殊歷史時(shí)期礦業(yè)用地法律制度的學(xué)習(xí)研究,總結(jié)經(jīng)驗(yàn)教訓(xùn),從而反觀我國(guó)當(dāng)前的礦業(yè)用地法律制度,去粗取精,去偽存真,以期從礦業(yè)用地取得、使用、退出及糾紛解決等各個(gè)方面完善現(xiàn)代的礦業(yè)用地法律制度,更好的促進(jìn)國(guó)家、社會(huì)、經(jīng)濟(jì)、生態(tài)環(huán)境的發(fā)展。
[Abstract]:As one of the stages of the Republic of China, the Anti Japanese War played an important role in the period of the Republic of China and in the history of the Republic of China. At that time, the social chaos was in succession and the situation was disorganized. In this context, the national government vigorously developed mineral resources by formulating various laws and regulations and policies, and strictly controlled the mining land for war. The relevant laws of mining land in this period are mostly from the development and evolution of the mining land law of the Republic of China before the war of resistance to the Anti Japanese War, and continuously amended on the basis of the mining law of the Republic of China and its supporting laws. At the same time, a series of laws and regulations for mining land have been formulated, and the specific regulations and successive adjustments of the mining land have been made and gradually adjusted. The legal system of mining land in the period of the war of resistance to the war of resistance. This article, taking the Republic of China as the background, studied and analyzed the legal system of mining land in the period of the Anti Japanese War, and reappeared the evolution and development course of the legal system of mining land in this period. On the basis of this, the basic concepts of mining land, the mining land acquisition mechanism, the mining land withdrawal mechanism, the mining land dispute settlement mechanism and so on, and the objective evaluation of its content and effect are evaluated. History is a mirror and through the Anti Japanese war. In the special historical period, the study and study of the legal system of mining land are studied, and the experience and lessons are summarized, so as to reflect the current legal system of mining land in China, to improve the quality of the mining land and to remove the false and save the truth, in order to improve the modern mining land legal system in various aspects, such as the acquisition, use, withdrawal and dispute settlement of the mining land, and better promote the state, the society and the economy. The development of the ecological environment.
