【摘要】:產(chǎn)權(quán)保證保險(xiǎn)制度起源于美國,歷經(jīng)一百多年的發(fā)展和完善,在美國不動(dòng)產(chǎn)交易中占據(jù)重要地位,成為保障產(chǎn)權(quán)安全的重要制度,并為促進(jìn)美國二級(jí)抵押市場的出現(xiàn)和發(fā)展做出重要貢獻(xiàn)。不動(dòng)產(chǎn)的產(chǎn)權(quán)質(zhì)量是人們普遍重視和關(guān)系不動(dòng)產(chǎn)市場發(fā)展的關(guān)鍵問題。由于美國不完善的不動(dòng)產(chǎn)登記制度和傳統(tǒng)產(chǎn)權(quán)保證方法的不足,使得產(chǎn)權(quán)安全成為人們不動(dòng)產(chǎn)交易中最為關(guān)注的問題和最大的困擾。產(chǎn)權(quán)瑕疵和產(chǎn)權(quán)糾紛不僅會(huì)阻礙產(chǎn)權(quán)權(quán)利的行使,更有可能使不動(dòng)產(chǎn)買受人面臨完全喪失產(chǎn)權(quán)的風(fēng)險(xiǎn)。產(chǎn)權(quán)保證保險(xiǎn)制度的產(chǎn)生,就是以產(chǎn)權(quán)保護(hù)為出發(fā)點(diǎn)和制度核心,同時(shí)吸收和借鑒美國傳統(tǒng)產(chǎn)權(quán)保證方法的益處,有效彌補(bǔ)其缺陷,成為美國不動(dòng)產(chǎn)登記制度的有益補(bǔ)充。此外,基于不動(dòng)產(chǎn)登記制度進(jìn)行產(chǎn)權(quán)調(diào)查、制作產(chǎn)權(quán)報(bào)告、建立產(chǎn)權(quán)鏈,發(fā)現(xiàn)產(chǎn)權(quán)風(fēng)險(xiǎn)并解決,保證產(chǎn)權(quán)安全,提升產(chǎn)權(quán)質(zhì)量。產(chǎn)權(quán)保證保險(xiǎn)制度的獨(dú)特承保機(jī)制和預(yù)防產(chǎn)權(quán)風(fēng)險(xiǎn),提升產(chǎn)權(quán)質(zhì)量的核心內(nèi)涵使其成為一項(xiàng)非常獨(dú)特的制度。產(chǎn)權(quán)保證保險(xiǎn)制度的有效應(yīng)用使美國擁有世界上最有效率的不動(dòng)產(chǎn)轉(zhuǎn)讓系統(tǒng),并促進(jìn)二級(jí)抵押擔(dān)保市場的形成和發(fā)展。產(chǎn)權(quán)保證保險(xiǎn)制度發(fā)展至今,已成為美國不動(dòng)產(chǎn)交易中保護(hù)產(chǎn)權(quán)的重要制度。隨著經(jīng)濟(jì)全球化和國際不動(dòng)產(chǎn)交易市場的形成和繁榮,產(chǎn)權(quán)保證保險(xiǎn)不再是美國獨(dú)有的制度,產(chǎn)權(quán)保證保險(xiǎn)的國際化程度提高,已被移植到越來越多的國家。國際產(chǎn)權(quán)保證保險(xiǎn)制度不僅具有美國產(chǎn)權(quán)保證保險(xiǎn)制度在保護(hù)產(chǎn)權(quán)方面的內(nèi)涵,更適應(yīng)各個(gè)國家和地區(qū)的具體情況,在承保風(fēng)險(xiǎn)、承保范圍、承保程序等方面做出改變,并成為職業(yè)責(zé)任的有益補(bǔ)充,同樣發(fā)揮著保護(hù)產(chǎn)權(quán)安全的重要作用。國際產(chǎn)權(quán)保證保險(xiǎn)銷售量的不斷增長證明國際產(chǎn)權(quán)保證保險(xiǎn)確實(shí)具有無限的市場潛力。雖然,目前產(chǎn)權(quán)保證保險(xiǎn)制度還未被引進(jìn)到我國,國內(nèi)對(duì)于產(chǎn)權(quán)保證保險(xiǎn)的研究也很少。但是,在我國房地產(chǎn)市場不斷發(fā)展的今天,產(chǎn)權(quán)安全必將受到越來越多的重視,因此,產(chǎn)權(quán)保證保險(xiǎn)制度對(duì)我國也具有重要的借鑒意義。
[Abstract]:The property right guarantee insurance system originated in the United States. After more than 100 years of development and improvement, it occupies an important position in the real estate transactions in the United States, and has become an important system to ensure the security of property rights. And to promote the emergence and development of the secondary mortgage market in the United States to make an important contribution. The quality of real estate property rights is a key issue that people attach importance to and relate to the development of real estate market. Because of the deficiency of American immovable property registration system and traditional methods of property right guarantee, the security of property right has become the most concerned problem and the biggest problem in real estate transaction. Defects and disputes of property rights not only hinder the exercise of property rights, but also make real estate buyers face the risk of complete loss of property rights. The emergence of the property right guarantee insurance system is to take the property right protection as the starting point and the core of the system, at the same time absorb and draw lessons from the benefits of the traditional American property right guarantee method, effectively remedy its defects, and become a beneficial supplement to the real estate registration system in the United States. In addition, property right investigation based on real estate registration system, making property right report, establishing property right chain, discovering property right risk and solving, ensuring property right security and improving property right quality. The unique underwriting mechanism of the property right guarantee insurance system and the prevention of the property right risk, and the core connotation of improving the property right quality make it a very unique system. The effective application of the title guarantee insurance system enables the United States to have the most efficient real estate transfer system in the world and promotes the formation and development of the secondary mortgage guarantee market. The property right guarantee insurance system has become an important system to protect property right in American real estate transactions. With the economic globalization and the formation and prosperity of the international real estate transaction market, the property right guarantee insurance is no longer a unique system in the United States, and the degree of internationalization of the property right guarantee insurance has been increased, which has been transplanted to more and more countries. The international property right guarantee insurance system not only has the connotation of the American property right guarantee insurance system in protecting property rights, but also adapts to the specific conditions of various countries and regions, and makes changes in the aspects of underwriting risk, coverage scope, underwriting procedure, etc. It also plays an important role in protecting property rights. The increasing sales volume of the international property right guarantee insurance proves that the international property right guarantee insurance has unlimited market potential. Although the property right guarantee insurance system has not been introduced into our country at present, there is little research on property right guarantee insurance in our country. However, with the continuous development of the real estate market in our country, the security of property rights will be paid more and more attention. Therefore, the property right guarantee insurance system is also of great significance to our country.
