【摘要】：成吉思汗《大札撒》中包含著多方面的法律制度內(nèi)容,其中的刑法制度占主導(dǎo)地位。其刑法制度在犯罪類型方面已包含了社會(huì)生活的各個(gè)方面,體現(xiàn)了當(dāng)時(shí)的社會(huì)控制內(nèi)容和方式,在刑罰處罰方面也具有特殊的犯罪處罰手段。作為《大扎撒》主體內(nèi)容的刑法制度,對(duì)我們認(rèn)識(shí)古代游牧地區(qū)法律制度產(chǎn)生、發(fā)展的獨(dú)特特征具有重要的啟發(fā)意義。
[Abstract]:Genghis Khan contains many aspects of the legal system, in which the criminal law system dominates. Its criminal law system has already included various aspects of social life in the crime type, reflected the social control content and the way at that time, also has the special crime punishment method in the penalty punishment aspect. The criminal law system, as the main content of Da Zasa, is of great significance for us to understand the unique characteristics of the legal system in ancient nomadic areas.
