【摘要】：通過反思西方學界關于中國法律傳統(tǒng)的代表性研究,著重指出無論是冷戰(zhàn)背景下將中西方法律對立,還是其后"發(fā)現(xiàn)"中國法律傳統(tǒng)的"現(xiàn)代性"的嘗試,其背后都與西方學術思潮和政治有密切的關系,西方學界對中國法律傳統(tǒng)的研究無法脫離西方學術本身,亦可看到西方理論及其背后的價值預設對認識中國法律傳統(tǒng)的誤解。從"實踐"出發(fā),關注法律具體的運作,嘗試融匯中西并尋求對諸多二元對立范疇的超越,是全球化時代背景下西方學術界中國法律傳統(tǒng)研究的重要趨勢。
[Abstract]:By reflecting on the representative research on Chinese legal tradition in western academic circles, this paper emphatically points out that whether it is against Chinese or Western law under the background of the Cold War, it is also an attempt to "discover" the "modernity" of Chinese legal tradition. Both of them are closely related to western academic thought and politics. The study of Chinese legal tradition in western academic circles can not be divorced from the western academic itself, and can also see the misunderstanding of western theory and its value presupposition in understanding Chinese legal tradition. Starting from "practice", paying attention to the specific operation of law, trying to merge Chinese and Western countries and seeking to transcend many dualistic opposing categories, it is an important trend for the western academic circles to study Chinese legal tradition under the background of globalization.
